I could be wrong, but I don't think Lois Learner took a retirement, as I believe she was a political appointee, not a career civil servant. 

 

You know, I don't believe in leaks.  I think it is a cowards way out.  When I was the Deputy Director at our agency, someone leaked an internal email that I had written.  It was in the Washington Post.  There was nothing untoward about it - I mentioned that people should not act like terrorists, i.e., dropping a bomb on the table at meetings and then sitting back to watch what happens.  The Washington Post sent me an email at 11pm at night, which I totally did not see until morning, asking me for comments.  It was totally taken out of context.  I knew who leaked - it wasn't the first time this person had leaked something.  He was mad at the agnecy because years before and with a different director, his little feelings got hurt because the then Director, told him to change a position he had taken on something.  He refused, so the Director changed it for him.  When you are a govenrment employee, you get to argue for your position until a decision is made, and then you are expected to support the decision.  Not leak your position to the media.  If you are wondering why we didn't just fire this person, they did.  But he claimed immunity under the Government Whistle Blowers protections, so he couldn't be fired.  Instead they isolated him and gave him nothing meaningful to do,which then led him to just write more incindiary articles under his own name. 

So I wonder what is up with this leaker?  Closet Democrat, or have his/her little feelings been stepped on and it is a act of revenge?

Leak a crime you are protected by whistleblower status. 

Leak info not directly related to a crime, YOU go to jail.

Okay, so she was a career civil servant.  It's unfortunate but true that people can be put on Administrative leave and be paid your regular salary for not working.  I had one that collected 45 days of administrative leave pay, having lost his security clearance for cause,  while I was working with personnel to get him fired.  I know a guy that collected for 2 years.  He lost his security clearance, so he "lost his job" while they worked on firing him. He grieved it and they had to pay while until he wore out all of his appeals (not to mention he spent his entire retirement savings trying to get reinstataed).  I think most organizations do this to keep from getting sued. 

Do I think it is fair? No.  If you do something wrong, you should be taken off pay status, and if you are found not guilty or get reinstated, then pay them back pay. 

Ms. Learner was very fortunate to continue to be paid. As a Senior Executive, she could have been fired immediately with no chance for appeal.

That may be how it is supposed to work, but that is not how it works.  Employee claiming Whistle Blowers status had some in Congress that thought he was right, even though there was nothing criminal about it.
