It appears so given his testimony that he was the leaker of the memo.  Along with being a weak willed wimp, he admitted that he leaked classified information to the press through his law professor buddy.  You see, under federal law any conversations with POTUS are subject to executive privilege and are by law classified unless and until the President declassifies it.

Now don't think I will ever expect that he will be indicted for this blatantly obvious crime.  Having said that, who knows what Mueller will do.

My biggest concern is Comey worked for Mueller for years and they are supposed to have a good relationship.  I think Comey brought out the leak publicly yesterday as an admission so that the media can have their fun and the chance of being indicted goes away.  I don't like the Mueller - Comey history......does Mueller protect his friend?  Does Mueller owe a favor to his employee?  Does Comey have "photos"?

This is my take:  Unless he sent a copy to the WH, and by lack of response received tacit approval, his memo is just his memo.  Just because he wrote an MFR of a converation or meeting, for his own personal files, it doesn't mean anything  It's just his personal recollection, with his inherent bias and perceptions.  It's not worth the paper it is written on. 

Now if it violates executive privilege, I don't know.  People write MFRs all the time - but unless it is sent to the others in a meeting or conversation, it doesn't mean a thing. 

And Comey admitted that Trump never said anything again about Flynn.  My thought is this:  Trump felt bad about having to fire Flynn and didn't want to see something bad happen to him, becasue he personally liked him.  Trump had the authority to tell the FBI to cease and desist on the investigation or to pardon Flynn, but has done neither.

I agree with your take on this....not that sanity will prevail in the swamp of DC.

As to the executive privilege assertion, according to a former federal prosecutor that I heard discussing this issue, the conversations between the President and administration personnel are by definition covered under privilege.  Seems consistent with all the refused answers in the recent testimony.  Only POTUS can declassify his official conversations.  Again, I am under no illusion that Comey is in real legal jeopardy given the politics and as pointed out above, his personal relationship with Mueller.  But it appears he should be lawyering up.  Either way, at least he did not obviously perjure himself by now suddenly claiming Trump pressured him contrary to his earlier sworn testimony.  He may be a feckless, limp wristed pajama boy but he isn't that stupid.
