O'k, I'm not trying to stir up anything cause I don't care one way or the other but I have some questions I would love answered.                                                                                                           

   1) If I request an Absentee Ballot (AB) and I die BEFORE it's mailed, is it valid? (filled out by me and mailed by spouse/executor)       

   2) If I request an AB, fill it out and it is mailed, but I die before election date, is it valid?

   3) If I die and my spouse immediately requests an AB in my name, fills it out and mails it, is it valid?                                                                                                                                                              

   4), 5) and 6) same scenarios with 'Mail In Voting' ballots.                                                                   

   7) Do you believe that a state Secretary of State will/should spend the time/resources investigating/prosecuting any of these scenarios if they are found to be fraudulent?

 1) If I request an Absentee Ballot (AB) and I die BEFORE it's mailed, is it valid? (filled out by me and mailed by spouse/executor)     I would say invalid but gray area, I would think this would be much like if you went to a polling place, filled it out and died at the table before actually having your ballot recorded - should someone pick it up from the floor and process it?  your intention was indicated you were just unable to complete the process, I would hope that someone would process it in the case of witness seeing you die after having filled it out.  filling out a ballot at home, who is to say that you filled it out before you died vs spouse/child/caregiver who is wanting to defraud a vote.  Assuming nothing to indicate a crime, it will probably count as a actual vote, and would not be able to be prosecuted unless someone bragged about it, or so other evidence that the vote had issues.  Edit - now if you died at the table and late that evening the ballot was found and no one realized whos it was much like with other evidence without being able to say it was not altered during the time it was there hopefully a poll worker would not process it, but they probably would anyway ( unless they did not like what marks they saw and just tossed it.)  

   2) If I request an AB, fill it out and it is mailed, but I die before election date, is it valid?  I would say valid, it would hopefully have a postmark before you died, short of some other evidence someone did something - there is no way to prove you did or did not, so would say valid unless there was a reason not to.

   3) If I die and my spouse immediately requests an AB in my name, fills it out and mails it, is it valid?       I would go 100% not only no but hell no, even if you told your spouse how you wanted to vote as your dying breath and then the ballot was requested.  This should be fraud.       You can not transfer your right to vote to someone else.                                                                                                                                               

   4), 5) and 6) same scenarios with 'Mail In Voting' ballots.      See above - same arguements could be made about in person voting  but the person died in line.                                                             

   7) Do you believe that a state Secretary of State will/should spend the time/resources investigating/prosecuting any of these scenarios if they are found to be fraudulent?  Depends - probably only way someone would get caught in many of these is someone posting something on social media or something to indicate that they voted for someone deceased ( much like what happens today ).

In many of these scenarios, how would anyone know unless someone spilled the beans to a friend/family/social media ?  If there is a reason to investigate I would say investigate and if someone is guilty of voter fraud they should be investigated and punished appropriately.  If there is no evidence of a crime then chances are it will not be investigated under any circumstances.

What is the differene between an absentee ballot and a mail in ballot? They would both be handled the same way.  As to a ballot counting after death, it varies by state. In NY, it states that if it were reported the ballot would be thrown out. In Florida, once it is postmarked it counts. The election law in Alabama seems to be quiet on the subject.

He knows the difference and is just being snarky.  Like most Dems he wants millions of ballots floating around in the mail system so they can be harvested, filled out and sent in without any proof that it represents the wishes of the voter....assuming the voter is even alive or living there.  Claiming to not know the difference is so childish.

My response was not some wild azz response...rather it was in response to the inquiry. I repeated the question and answered it.

Yeah, that was totally unclear if that was your intent...which is suspect.  But if you think they are handled the same way you are exactly wrong and either ignorant or you are lying.  First, a registered voter must request an absentee ballot using all their personal information, a certification statement and a signature.  It is then confirmed by the secretary of state and a ballot is then mailed to the person that requested.  Presumably if you are dead or have moved you aren't going to request an absentee ballot although someone else could obviously do so.

With the concept of mail in ballots every single person that is listed as a registered voter has a ballot mailed to the address of their registration.  As we have seen where this is tried it is rife with fraud.  Much worse than absentee ballots.

BUT he believes that they are handled the same way by both the voter, postal service etc.

 

So if I sit on my butt and do nothing I will get my absentee ballot to just show up at the house, Great news!!!!!!  Then I can put in the garbage and go vote in person with my ID.

 

Considering that I have had so many problems with USPS over the years that I signed up where I get a scan of every piece of mail coming to my house. They still lose some, and hell recently they misplaced one that had tracking information.  And just last week had a package coming USPS w/tracking - was picked up, information they emailed to me was correct in terms of address, and delivered the same day, to the front door of the place it was ordered.  Got to follow up in a few hours when California hits 8am and find out what happened.  

I do not trust USPS with regular mail or spam mailbox stuffing - Why the hell would I trust them with my vote.

Have a special box for the burn pile, collect it in some old cardboard box in the garage and burn every few weeks depending on weather.  Just got 500 rounds of 9mm ammo that have various defects and have to be pulled apart and reloaded - since we do not know what gunpowder it is just get to add it to the burn box - but that burn box will be handled at the end of each day pulling rounds apart. 

 

Helped a friend pull apart 300 rounds of 30-06 old military surplus rounds with corrosive primers - when we lit it off had a fireball about 6 foot tall over about 20 seconds - old limbs and stump caught quickly and later had a really good bonfire.
