I think that you missed the point for this posting. There has never been a thought or statement from me me that Alabama Power does not have a legal authority to use Smith Lake to generate electricity and revenue as a publicly owned corporation. The intent of this posting was to show that Smith Lake is only part off the total equation for electricity generation in this area and there are water level movements for electricity generation other than hydro only (ie, coal fired steam at Gorgas).

Ownership to me means that there is a deed or some other type of document involved that could be used to prove ownership. Who owns national forest, rivers, etc.? Does Alabama Power have a deed? What about the property rights from 510 to 520? Does Alabama Power own this land? I suspect that Alabama Power would say no. Do property owners pay taxes on land between 510 and 520? Do property owners plant grass, trees, shubs, etc. between 510 and 520 only after getting permission from Alabama Power's?

Why is Alabama Power required to have a permit from FERC for Smith Lake? Who owned this land prior to the lake being formed? Was Eminent Domain used at any time during the securing of the land for Smith Lake? Are there issues in the permit such as other than hydro generation that will be considered by FERC? I think that there are some other non hydrogeneration issues tthat the FERC will consider prior to granting a 35 year permit.

During my conversation with the Alabama Power representative, the statement was made that Alabama Power plans no changes in the way that they will manage Smith Lake if the permit is grantted. The point was also made that FERC might also issue the permit with qualifications. Time will tell as to what the permit for the next 35 years will require of Alabama Power.
