Winter Water Levels:

Alabama Power Company notified us on November 24, that they had requested
a variance to increase winter water levels for Lake Harris (Wedowee)
because of the continuing drought. The Corps of Engineers approved the
variance on November 25, and APCo has begun raising the level of Lake
Harris.

Also, APCo officials indicated to us that they would probably apply to
FERC sometime this week to request a winter level variance for Lake
Martin. We received confirmation today that APCo expects to file that
application with FERC today. Approval will take longer since the request
is not filed as an emergency application. We may ask HOBO members to
write letters of support for the application to FERC as we did during the
2007 application.

The variance request will be the same as last year which will provide for
earlier filling of the lake, if we receive the necessary rains. It is
unclear how low the level will be allowed to reach, but the lake may reach
the 480’ level before refilling to the level of 483’ (if approved by FERC).
The request permits a temporary winter level of the lake at 483’ and
refilling the lake will begin on January 15, instead of February 17.
