The law as I understand it is that an open container is not illegal, even by the driver of the boat. I think the problem some of us have with enforcement is the "Why Me?". I would guess that 90% of the boats out cruising LM at sundown have booze onboard, including driver. So what? Moving at maybe 5 MPH,,, no danger to nobody. Should the MP use manpower to check it out? Waste of time. That's me. However, during the day, in congested areas especially, with many boats, many skiers, tubes, etc. and a boat of folks openly drinking booze? Yep, check them out. If they are BUI, lock them up.
