Now wait - is he being asked to testify as a public employee or as a private individual contracted by the Clintons to set up and maintain the server? And what has he been given immunity to? Are there other charges pending or is he afraid that there will be other charges pending, based on whatever he says? If he is being asked to testify as a private contractor to the Clintons and he is to testify about how he set up the server and how he maintained the server or what he saw on the server, you can bet that he is being paid big bucks by the Clintons to keep his mouth shut.
Truthfully, there is so much we don't know. I suspect he was a Schedule C employee at State, which is a type of political appointment, but at a much lower level, so he worked there while Clinton was SecSTate, but left when she departed.
It is the political appointees that usually are not held legally accountable for their decisions - they are afforded the opportunity to resign. I guess they could be held criminally negligent if the WH or the Justice Department choose to prosecute them. But that is not how Washington works. You can bet that when I was a public employee would have fired from my job and criminally prosecuted if I did what Hilary or Patreus did with regard to classified information.
If elected, will Trump choose to prosecute political appointees for their bad decisions, or will he too be satisfied with "you're fired".
