I had the good fortune, this past weekend, to meet a lawyer who is part of the team preparing Florida’s constitutional challenge to the HCR which we just had rammed down our throat. With great interest I listened to him. The fellow and his wife have made a fortune in anti-trust law and he is a Con-law genius. There is a glimmer that our republic may prevail over the lawlessness, dishonesty, and dissembling in Congress and the White House.
He carefully explained BOTH sides of legality argument. The Tenth Amendment will prevail. The Commerce Clause has been stricken down previously.
There are 38 states preparing or planning litigation over this travesty.
I looked at Alabama's roll vote: UNANIMOUS! Democrats -- Bright, N; Davis, N. Republicans -- Aderholt, N; Bachus, N; Bonner, N; Griffith, N; Rogers, N.
