I had a similar thing happen to me for a real estate partnership account. I had just taken over an apartment property. the natural gas company had not been paid and the cutoff was in 2 days. I called them to see how I could buy time and was told to fax a copy of the check, mail it and they would hold off. I did and they not only cashed the check but used the faxed copy to debit the account. The bank never called me - and I had lots of accounts with them - and I got charged twice for the $9,000 owed. To make it worse I had a private banker that was supposed to give me special service. Apparently banks can just take the money out for anyone that has the account number and ask questions later. After 60 days I finally got the partnership's money back. We don't have a regulation problem, we have a morality problem.
