It is not an illegal appointment.  The man has been named "acting" which means that he is a place holder until the nominations for the position are made and then confirmed.  Now if he was "appointed", he would still be subject to confirmation process.  People make up crap all the time about what is allowable and what is not.  There is a lot more to the Justice Department than just the Mueller investigation and the everyday work needs to still get done.  But I also think the President is sending Roberstine a message.
