I get your point and if he was being charged for lying to investigators that's one thing. But now the police are going to be held criminally liable for their judgement or lack of good judgement? The problem here is that while this one seems like a solid case, the next ones maybe not so much. So now police officers in a scary situation not only have to worry about being fired or sued for their decisions, they also have to be worried about being criminally charged if they make a bad decision that results in someone being killed by a perp.
So the SWAT team decides to wait to breach a hostage situation and people inside die. Are they criminally negligent? All it takes is a DA who doesn't like the police or has an axe to grind and they get an indictment. I'm sorry, but this is still a very bad idea even given the circumstances which we all agree are egregious.
