The below is a copy of an email sent to all HOBO members this morning in case anyone on the forum would like to also send a letter to FERC supporting APCOs request for a temporary winter variance.

Dear HOBOs:

As most of you are aware on October 23, 2007, Alabama Power Company (APCo) petitioned the Federal Energy Regulation Commission (FERC) for a drought-based temporary variance to Lake Martin's rule curve. To review APCO's letter to FERC -- see the link below.

An overview of the temporary variance APCo is requesting is as follows:
(1) a winter pool elevation 3 feet higher than normal, at elevation 483 feet instead of elevation 480 feet;
(2) maintaining the winter pool elevation earlier than normal, on November 20th rather than January 1st;
(3) initiating the filling process earlier than normal, beginning January 15th instead of February 15th; and
(4) reaching and maintaining summer pool elevation earlier than normal, on April 1st rather than May 1st.

FERC is currently requesting comments from all interested parties regarding APCo's request. Now is the time for all to stand up and be heard, as this could just be the beginning. FERC needs to understand we appreciate and support APCo's request for the temporary variance in the rule curve. This is a very important matter, not just for today, but as such if not more so for the future, so please write your letters to FERC.

Per FERC's letter of November 1, 2007 the following are the requirements for submitting comments regarding this matter:

- All documents (original and eight copies) should be filed with: Ms. Kimberly D. Bose, Secretary, Federal Energy Regulatory Commission, 888 First Street NE, Washington, DC 20426.

- You may also set up a FERC online user account at
https://ferconline.ferc.gov/FOL/eRegistration/Default.aspx?PID=1 and file your comments electronically by uploading your computer file to FERC's website. If you are not computer literate we would not suggest attempting to file your letter electronically with FERC, as such is rather cumbersome.

- Any filing must bear in all capital letters the title "COMMENTS", "PROTEST", or 'MOTION TO INTERVENE", as applicable, and the Project Number of the particular application to which the filing refers. – So please use the following as your letter subject RE: COMMENTS – Martin Project, FERC No. 349 - 134.

- Deadline for filing Comments, Protests or Motion to Intervene is November 14, 2007.

In your letter to FERC please be sure to include the following at a minimum:
- You are a Lake Martin stakeholder
- You appreciate and support Alabama Power's efforts in requesting a temporary variance in the Lake Martin rule curve dated October 23, 2007.
- Why in your opinion you support the temporary variance
- Your legal name and address
- Lastly, if you feel a permanent variance in the Lake's winter rule curve to 484' or 485' is also warranted for the betterment of Lake Martin and the surrounding communities long-term, please state such as well. And if so, why you feel such a permanent change is important for the future.
