I don't want to split hairs with you, but in days of old, it was an act of war because countries actually owned the ships or sailed under "contract" to the government and therefore attacks on the ship were considered an attack on the country. But, in this case, you are talking about commercial ships (not Navy or government ships)undertaking a commercial voyage and the fact remains that defense of civilian interests constitutes "police" action. And the President has to make the determintation. In fact, I think he has to do it in consulation with Congress.
