No, that's not what he is saying. He is leaving open the possibility of the lawyers who interpreted the law as to the actions proposed and gave a legal opinion may have deliberately misinterpreted the legal definition of torture. This is a very fine line, and I have a feeling that the AG will not chose to pursue it.
In order for Bush to be tried for "war crimes" they would have to be able to prove that he deliberately overrode a legal opinion and directed the torture. Believe me, all Presidents are kept well insulated from this kind of stuff.

This is a tempest in a teapot. All Obama is saying is that he's not going to deny review and possible prosecution. Nothing is going to come out of this because the AG would have to produce witnesses and documentation that the lawyers knowingly and willingly misinterpreted the law.

And think about it, if the lawyers who interepreted the definition of torture did so deliberately, shouldn't they be prosecuted? Government lawyers serving the Administration are supposed to objectively interpret the law and make sure that the Administration stays within the limits of the law, not bend to political pressure.
