Try proof reading next time. Synopsis says within 100 miles of the Gulf Coast, the verbiage of the bill says within 50 miles of the Gulf Coast. Which would it be?

Some smarta$$ staffer caught the language and a Substitute Bill has been submitted. The important changes are:
Section 1. (a) This bill shall apply to the operation of certain recreational boats in inland waterways, rivers, and streams that are within 100 miles (MY NOTE - CHANGED FROM 50) north of the Gulf of Mexico shoreline, (MY NOTE - ADDED) and to areas on the Alabama River that are located within three miles of the city limits of Montgomery, Alabama excluding the Tenn Tom Waterway and Intercoastal Waterway.
The "full version" is available on the legislative web site http://alisondb.legislature.state.al.us/acas/ACASLogin.asp; click on the bill number (HB625); the Amds/Subs to view the substitute.
It is on the fast track for approval. The second reading was 4/16 and is scheduled for the third reading/vote today. And what a mixed bag of sponsors/cosponsors - 3 D; 8 R; and they represent from Mobile to Jefferson Counties. The good news is I can't find a companion bill that has been introduced in the senate.

PP, that is not that bad of a deal. It was the 3 miles from Montgomery I was worried about. That would mean a 3 mile plus no wake zone for anything larger than 28 ft.

Ok, think of it like this. Idle speed from shore or piers, and only in the area of 100 miles north of the Gulf coast. Most rivers are not 600 feet wide, unless my distance perception is completely off. So you will have to idle a minimum of 5 miles either direction to get to Lulu's. How about other marinas that are a little inland? My issue is once the law is one the books it is EASY for them to "extend" or "modify" to include other areas.
Instead of saying "It's not too bad" how about asking "What will it fix"???? It will not stop any property damage allegedly caused by wake board boats throwing wakes in close quarters. It will not stop deaths like the one where the lady struck the pier at high rate of speed on the PWC. If there is some merrit to it, why is it limited to certain geographical area? Purely political. Who benefits from it? Why? Where are the studies?

Cat and PP; please read the substitute closely. It changed the area covered to include "and to areas on the Alabama River that are located within three miles of the city limits of Montgomery,". My other question is does this apply to RIVER MILES or AS THE CROW FLIES?

Within 3 miles of the Montgomery City limit. "Idle" speed, or "No Wake"? I can guarentee that a river boat would need more than idle power to go up river, and need more than odle speed for the rudders to function. So, if the river boat goes to throttle setting beyond "idle" they will be violating this law!!!!!!!!!

3 miles??? That means from the ramp I use in Prattville, I'll go about 3 miles, and then idle for 3 miles as I approach Montgomery. There is not one house or pier or anything on that side of Montgomery. And, even after I get to Montgomery, there is one riverboat, one marina in a cove and a couple houses on up the river. I can't believe they would put a bouy out that says "If your boat is 28' long idle for the next few miles?

Maxwell AFB is in the city limits. The wesward city limits stops aboout 2.5 miles from the river bridge. So, if you put in at Cooters you would have to idle until about .5 miles WEST of the HWL 31 river bridge.

The substitute bill:
20 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
21 Section 1. (a) This bill shall apply to the

2 traffic of commercial boats and vessels.
3 Section 2. Operators of recreational boats over 28
4 feet in length traveling on inland waterways, rivers, and
5 streams shall reduce the speed of their boats to idle whenever
6 a boat is traveling within 100 yards of any shoreline,
7 boathouse, or pier.
8 Section 3. This act shall become effective
9 immediately following its passage and approval by the
10 Governor, or its otherwise becoming law.
Notice that it only applies to “recreational boats over 28 feet in length”, it applies to the Alabama River within 3 miles of Montgomery but does not apply to the Tenn Tom Waterway, it does not apply to intercoastal waterways (the intercoastal between Mississippi Sound and the Ala/Fla state lines including LuLu’s and The Wharf), and it does not apply to commercial vessels.
Gulf Coast Tourism for large, privately owned yachts be damned. Look at the sponsors and you will understand some of these exceptions. Four from Mobile County – none from Baldwin County; Tuscaloosa County (Tenn-Tom area), and none from The River Region. You can contact your legislator via email at their web site http://www.legislature.state.al.us. CAT, are you going to contact Barry Mask since you guys are so close?

Do they mean idle speed north of that 100 mile line, or south of it? Even the exceptions muddy the waters. The Tenn-Tom is mostly, if not fully, 100+ miles north of the gulf, but the Intracoastal Waterway is obviously very close to the gulf.

The proposal only impacts recreation boats - I doubt it would apply to the riverboat. Still comes back to the same question - other than padding another state employee's wallet, what is the purpose? Vote them all out and start over. That won't happen on this because OUR legislators are yet again targeting a very specific type vessel in limited locations - just like the assault boat ban, the people of this state have decided that if "it does not affect me, so I could give a s***".
