Muslims are NOT exempt from Obamacare. Actuallyy, they have no issue with health insurance. They are against life insurance on religious grounds.

Amish, scientologists, Christian scientists and Muslims are exempted from the requirements of the health care bill.   Muslims are specifically exempted from the government mandate to purchase insurance, and also from the penalty tax for being uninsured.  Islam considers insurance to be "gambling", "risk-taking", and "usury" and is thus banned.  Muslims are specifically granted exemption based on this. (Is this perhaps a violation of the current legal interpretation of the 1st Amendment?)


From the Health Care Bill:

 

‘‘(A) IN GENERAL.—Subsection (a) shall not apply to any individual (and any qualifying child residing with such individual) for any period if such individual has in effect an exemption which certifies that such individual is a member of a recognized religious sect or division thereof described in section 1402(g)(1) and an adherent of established tenets or teachings of such sect or division as described in such section.

 

  

TITLE 26  Subtitle A  CHAPTER 2  § 1402

 

§ 1402. Definitions 

 

(g) Members of certain religious faiths

 

(1)    Exemption

 

Any individual may file an application (in such form and manner, and with such official, as may be prescribed by regulations under this chapter) for an exemption from the tax imposed by this chapter if he is a member of a recognized religious sect or division thereof and is an adherent of established tenets or teachings of such sect or division by reason of which he is conscientiously opposed to acceptance of the benefits of any private or public insurance which makes payments in the event of death, disability, old-age, or retirement or makes payments toward the cost of, or provides services for, medical care (including the benefits of any insurance system established by the Social Security Act).

If your religion allow a believer to be covered under Social Security then you cannot receive an exemption from coverage. Muslims pay unto and receive Social Security. Self employed Amish are exempt from paying into Social Security. Amish do not receive Social Security benefits and can be exempted from Obamacare. I repeat that Muslims are NOT exempt from Obamacare.

What do you not understand from my post? Maj post is not factual. Muslims are NOT exempt and cannot receive a waiver since they accept Social Security benefits unlike Amish who don't and can be exempt from Obamacare. Internal Revenue Code. The religious exemption applies to any person who is a member of a “recognized religious sect or division” with “established tenets or teachings” that would forbid that person from accepting public or private insurance. Thus the Amish, who believe in taking care of their own elderly and don’t participate in Social Security, are exempt, as are Mennonites and Scientologists.

My posting came a) directly from the Cornell University Law School interpretation and b) directly from the law itself.  Please note the citation at the end of my post.

 

With all of the special exemptions being filed, it seems we have evidence enough that the law does NOT equally apply to everyone.

While I am certainly not an expert, I was troubled when I first read about the exemption last year and decided to research it to see who was entitled to an exemption and the criteria to qualify. However, if in your mind that makes me an expert, than I am an expert. Thanks for the compliment.

I hired an Amish company in Lancaster PA to do some assembly work for me. The raw materials were shipped to them, they assembled the material, and fulfilled orders. They were pleasure to work with...honest and trustworthy. Never had an inventory loss issue or a schedule problem. They dressed as you would expect and buggies were in the parking lot. My most memorable incident was waiting in line at an ATM machine behind a buggy. The woman are great cooks. So, yes from my dealings with them I do consider them good people. You may be thinking of Witness the movie from 1985 with Harrison Ford.
