We need help from Forum members again. In today's Alex City Outlook and the Dadeville Record is an article with quotes from Dadeville officials and a proposed letter to be written to Lake Watch. The article is attached so I will not explain; however, we do feel that the Dadeville City Council and Mayor have done something that shows the arrogance and disdain for the law that they have shown throughout the past six months of dealing with the Dadeville Sewage Treatment Plant's dumping of raw, untreated sewage into Lake Martin. Twenty-nine (29) times Dadeville self reported these violations to the authorities at ADEM, Alabama dept. of Environmental Management. Twenty-nine times they received Notice of Violation letters from ADEM, yet they did nothing. Dadeville hid this information from the public for years.

Then Lake Watch members uncovered these violations when making a
personal search of ADEM's public records in early 2007. Dadeville still tried to deny a problem. ADEM then finally obtained a consent decree against the City to force the City leaders into action. Shortly there after, the Alabama Attorney General filed a civil suit against Dadeville for failure to act to repair the Treatment Plant and stop dumping sewage in OUR LAKE.

Then the HOBOs and Lake Watch, WITH THE HELP OF MANY FORUM MEMBERS, appealed to ADEM to hold a public hearing concerning the renewal of Dadeville's Treatment Plant License. Due to the efforts of many on the Forum, ADEM relented, there are very few public hearings allowed, and scheduled a hearing. Over 100 citizens attended the hearing and many spoke against the way Dadeville and ADEM had handled the violations.

Even with all of this the Mayor and City Council want to thumb their noses at the law and all of us. Read the article below. WE NEED YOUR HELP.
We would like everyone to write the Alex City Outlook a letter-to-the-editor and let the mayor and city council know that you don't appreciate the arrogance they have displayed through out this process. BTW, you'll read that the Dadeville Treatment Plant is far from being rebuilt, they are patching up to get ADEM and the AG off their backs.

You, most likely intentionally, made it sound like Dadeville just decided to 'dump raw sewage' into the lake. THIS IS BLATENTLY FALSE!! The only time sewage was discharged into the lake was during torential rains that overwhelmed the system. How did the city benifit from the meeting? Those that wanted it SHOULD pay for it. I think that the city should sue for return of the money.

Below is the Article explaining that the EPA has found that ADEM is very lacking in their active followup and enforcement of violations. This is why Dadeville was allowed to have 29 violations without any action until Lake Watch got involved. Remember, without Lake Watch, no one would know that Dadeville was allowing raw sewage to be dumped into OUR LAKE for over ten years. Let's do something about it. Write those letters and emails. It is not 'OUR LAKE' it belongs to APCO. And every time you post that Dadeville 'dumped raw sewage' I will remind everyone that Dadeville did not dump sewage. Mother nature washed it into APCO's LAKE with torrential rains. How many 'dumpings' have happened THIS year. NONE, there have been NO torrential rains to overwhelm the system.

If you think that the Dadeville politicians are SO HORRIBLE all I can tell you, again, is qualify and run for office. Stop being part of the problem and start being part of the solution. And the raised property taxes don't even need to be brought up. Just because you pay property taxes doesn't make you any different than anyone else. We all pay taxes. I have paid property taxes all my life, yet never had a kid in the schools. BFD!!

How about figuring out a way to help pay the $3500 for a meeting that YOU wanted. That $3500 could go toward more improvements at the WWTP. Yea, knew that wasn't going to happen. You want services, you MUST pay for them.

The water within Lake Martin is held in trust for the people of Alabama Per the below Federal and State laws:

Alabama Law Ala. Code § 9-11-80(a) (1998).

(a) All waters of this state are hereby declared to be public waters if such waters are natural bodies of water such as rivers, creeks, brooks, lakes, bayous, bays, channels, canals or lagoons or are dug, dredged or blasted canals and if these waters traverse, bound, flow upon or through or touch lands title to which is held by more than one person, firm or corporation. Any water impounded by the construction of any lock or dam or other impounding device placed across the channel of a navigable stream is declared a public water. All waters caused to be impounded or owned or leased by any municipality, county or other governmental unit are also declared to be public waters; likewise, all impoundments owned or operated by public utilities when such impoundments touch or bound lands title to which is held by more than one person, firm or corporation are declared to be public waters; provided, that before any person may go or be upon the posted lands of another for the purpose of fishing he shall procure the consent of the landowner or his agent.

Lake Martin is public water, as it is formed by the a navigatable basin -- The Tallapoosa River which was damed by the building of Martin Dam.

- The U.S. Supreme Court has ruled that rivers that are navigable, for title purposes, are owned by the states, "held in trust" for the public. This applies in all fifty states, under the "Equal Footing Doctrine."
- Rivers that do meet the federal test are automatically navigable, and therefore owned by the state. No court or government agency has to designate them as such.
- The federal test of navigability is not a technical test. There are no measurements of river width, depth, flow, or steepness involved. The test is simply whether the river is usable as a route by the public, even in small craft such as canoes, kayaks, and rafts. Such a river is legally navigable even if it contains big rapids, waterfalls, and other obstructions at which boaters get out, walk around, then re-enter the water

I have already heard from others that agree with my position, but who have do not wish to be 'involved' in the public forum. This forum does not belong to you or the HOBO's. If you want a forum to communicate with HOBO members, then CREATE ONE. Quit using this one as YOURS and quit bashing the locals. The forum was hear a decade or so before you or the HOBO's. Do mass emailing, telephone, or good ole paper and ink.

When you make a post it is up for all to see. Don't like it, don't post. As for my cohort 'flathead', don't know, don't want to him. If you feel I have 'ruined' the forum, GO AWAY. Simple enough. I would think even you could comprehend that. I will continue to post the truth, after each post that slanders our elected officials. Don''t like it, don't post! Are you seeing a pattern here yet? I don't see anyone BUT YOU making these statements. There are many more locals that frequent this forum than there are transplants like yourself. Not many folks like being insulted. There are, at my last check, three businesses listed under advertisers on the home page of LakeMartin.com who did not even know this site existed UNTIL I TOLD THEM and recommended they check it out and advertise here. I have never asked nor received anything in return for this. I did it to create what is a symbiotic relationship between them and lakemartin.com.

Now as far as I am concerned the likes of YOU is what is ruining the forum. NOT ME!!

Now pay for your silly meeting that accomplished NOTHING and get of the mayors case. AND LEAVE ME ALONE TOO!!

And, don't buy a boat over 26'11" that is capable of 60mph! (Ride the 26' as fast as you want???) Someone will tell you that you can't use it. My .02 worth. Who controls the lake? The State excepted my sales taxes when I bought my boat. And now, they don't want me to use it. Does the State of AL. control the lake. ??? Yall decide. I am out now.

Now you and I know that I met you face to face and really saw what a snivelling pathetic being you really are. Many Lake owners can't vote in Dadeville to remove those whom we do not support. My vote only counts in Elmore County, but I'm still affected by Dadeville's poor decisions.....that is why Lakewatch and HOBO's are so important! I find it appalling that these politicians would even think to ask Lakewatch to pay a bill that was brought forth due to their negligence.
