I was under the impression that it was illegal for passengers to be seated in front of the captain when a boat was in motion.  If that is the case, I assume it is a relatively unenforced law.  Trust me, I understand that our overworked Marine Police can't stop every boat for every minor infraction they see (and don't want them to), but there are a bunch of people riding on the driver's side in front of the driver.  My neice (who I have told can't ride in the front of the boat) pointed out every boat this weekend that had someone "where she wanted to sit"...Can anyone update me on this law, or lack thereof?

Bowriders are legal as long as they stay inside the boat while it's in motion.

There must be a hand rail accessible to passengers in the bow rider section of the boat.

As I understand it, You can be up there no problems if you have a rail and your hips should not ever be above that rail while underway. I like to set on the front of my boat when underway when I have a driver. How ever, I would never get up there when on plane above or below the rail. To rough.

Alabama Boating Regulations, Careless Operation section says: Careless Operation It shall be unlawful to operate a vessel in a careless manner upon the waters of this state. Careless operation is the endangerment of life, limb, or property through negligence, carelessness, or inattention of the operator. Examples of careless operation includes but is not limited to the following: Sitting in any position that is above the gunwale or cap of a vessel while moving above idle speed. Riding on bow of vessel not equipped with handrails. Riding on vessel with lower extremities hanging over the gunwale or cap of the vessel. Creating hazardous wake in congested area.

What about this part of the regs:

Operating a vessel above plane speed when persons or equipment are positioned in a manner that would obstruct the operator's view or impair the safe operation of the vessel. (Sailboats are exempt from this section)

I didn't think passengers were allowed in front of the captain either.  Here is what I found that COULD include these such passengers.

Boating Rules, Regulations, and District Offices

Prohibited Operations
Operating a vessel above plane speed when persons or equipment are positioned in a manner that would obstruct the operator's view or impair the safe operation of the vessel. (Sailboats are exempt from this section)
