TO ALL OUR FRIENDS AND CUSTOMERS. THANK YOU FOR YOUR SUPPORT OVER THE PAST YEAR

I WANTED TO BRING TO EVERYONES ATTENTION, THAT ANYONE WHO BANKS WITH ALIANT BANK AND HAS A BUSINESS ACCOUNT, YOU ARE NOT PROTECTED FROM FRAUDULANT WITHDRAWLS FROM YOUR ACCOUNT.

TWO WEEKS AGO MONEY WAS STRIPPED FROM OUR BUSINESS ACCOUNT BY POS WITHDRAWALS FROM THE U.K. ALIANT BANK DID NOT CONTACT ME TO SEE IF THESE WERE LEGITMATE PURCHASES OR NOT. THEY SIMPLY LET THESE COMPANIES STEAL OUR MONEY AND SAID THEY WERE SORRY THERE WAS NOTHING THEY COULD DO ABOUT IT. THEY WIPED OUT OUR ACCOUNT AND EVEN PAID THESE FRAUDLANT COMPANIES WITH MONIES THAT WAS NOT EVEN IN OUR ACCOUNT TO COVER THE WITHDRAWLS. NOW THE BANK WANTS TO COLLECT ON THOSE FUNDS AS WELL.

ANYONE WHO HAS A BUSINESS ACCOUNT WITH ALIANT BANK SHOULD GIVE SECOND THOUGHT ABOUT DOING BUSINESS WITH A BANK WHO CARES SO LITTLE FOR THEIR CUSTOMERS MONEY.

I would have to say you have a case against Aliant as it appears they were negligent in having proper controls in place to detect such activity and further safeguard your assets. I can tell you from personal experience with Regions Bank when we detect fraudulent activity on one of our business checking accounts, we contacted them immediately they were apologetic and within days righted the account. This did not happen just once over the years, but 2 or 3 times on various different checking accounts. Think if I were you I would call Aliant and insist on a face-to-face meeting with upper management and if they are not willing to accommodate you or the outcome of the meeting is not to you satisfaction I would inform them verbally and in writing that you will seek recourse regarding this matter with all federal regulatory agencies and civil actions as well. As fraud is their responsibility to detect and safeguard against and not yours, other than to contact them immediately if you suspect or detect such, which I am sure you did.

Might not be a bad idea to contact one of the TV news departments in Montgomery...sometimes publicity will cause a business to see their errors.

Might try calling Cathouse Lake Martin’s consumer advocacy department – I think Randy runs it.

As one of your very satisfied customers in Dadeville, I am shocked and upset to hear of this happening.  I can't understand HOW this could happen...sounds like Maverick gave some good advice above...good luck and keep us posted.

Here is some info from the FTC website: Fraudulent Electronic Withdrawals The Electronic Fund Transfer Act provides consumer protections for transactions involving an ATM or debit card, or another electronic way to debit or credit an account. It also limits your liability for unauthorized electronic fund transfers. You have 60 days from the date your bank account statement is sent to you to report in writing any money withdrawn from your account without your permission. This includes instances when your ATM or debit card is "skimmed"- that is, when a thief captures your account number and PIN without your card having been lost or stolen. The best way to protect yourself in the event of an error or fraudulent transaction is to call the financial institution and follow up in writing by certified letter, return receipt requested so you can prove when the institution received your letter. Keep a copy of the letter you send for your records. After receiving your notification about an error on your statement, the institution generally has 10 business days to investigate. The institution must tell you the results of its investigation within three business days after completing it and must correct an error within one business day after determining that it occurred. If the institution needs more time, it may take up to 45 days to complete the investigation but only if the money in dispute is returned to your account and you are notified promptly of the credit. At the end of the investigation, if no error has been found, the institution may take the money back if it sends you a written explanation.

I had a similar thing happen to me for a real estate partnership account. I had just taken over an apartment property. the natural gas company  had not been paid and the cutoff was in 2 days. I called them to see how I could buy time and was told to fax a copy of the check, mail it and they would hold off. I did and they not only cashed the check but used the faxed copy to debit the account. The bank never called me - and I had lots of accounts with them - and I got charged twice for the $9,000 owed. To make it worse I had a private banker that was supposed to give me special service. Apparently banks can just take the money out for anyone that has the account number and ask questions later. After 60 days I finally got the partnership's money back. We don't have a regulation problem, we have a morality problem.

Would not this type of theft be covered by the FDIC?   Would an individual account holder at Aliant be in jeopardy as well?
