I can answer your question.

Regarding removing homes or improvement from leased land.  You must read the lease/contract and check the law on fixtures.  You have not given enough facts for a more definitive answer.

Regarding depreciating something you don't own.  It can be done legally or illegally.

Painting ones house pink with purple polka dots would be likely to depreciate a neighbors property and in most cases would be legal.

Having ones hedge fund short a stock in an small publicly traded company could depreciate the value of the stock.

I could go on but you get the idea.

Why couldn't the powers at LANDS  use the over 150 million Berkshire dollars if needed?

And you're right, I don't have all the details of the lease. Yet. I'll get them later this week and get back with you. You seem to be versed in the details of renting. And to be fair, I will answer your questions (as best I can, because a couple of them have me scratching my head): Did Woody get his boat back? Who is Woody, and where is his boat? Did you know Toppy? If you're referencing Toppy Hodnett, yes, I knew him well. And I miss him terribly. He was a kind man. Why is DOJ asking questions about hacking? Homeland Security maybe? I think its one of the areas they are tasked with policing. Who was hacked, and who is being asked? Watch out for the ebay stuff, and the facebook games. And AOL will never contact you by email (so I'm told). Why couldn't the powers at LANDS use the over 150 million Berkshire dollars if needed? I don't know that Russell Lands owned Berkshire stock (As hard as it is to fathom, Ben Russell and Russell Lands are two separate, legal entities. Lands was split off from the Mill when everyone (Ben included) decided Ben wasn't right for the Mill, and the Mill wasn't right for Ben). But if they did own stock, they certainly could have used it. I've been told (I suspect it is true, but I don't have statements to prove it) they borrowed about that much over the past 10 years, so it could be used to offset those loans, if they controlled the proceeds of the sale and if in fact they owned that much Berkshire stock. And, if they haven't already spent it amongst themselves on grist mills, log cabins, surries with fringe on top, ice cream churns, crossroad developments where there never was a crossroad, medieval turrets to play fort within, 37 VPs (to include a VP of VPs), lighthouses, helicopters (where did that go?), swords, cannons, Tallapoosa Stonehenge (versions I through XXIV), and wood powered golf carts. Ben perhaps did personally, and if so, I suspect he could use that money to prop up the company as needed. That's what I would do if I found myself in their position (the position I'm told they are in), but you'll have to ask him/them. If they answer, and if their lips are moving, I wouldn't personally trust that what you're hearing is the truth.

Well I don't remember all of the details but B/H paid about $650 million for Russell Corp.  see sec filings from 2006 or  2007.  Or ask Warren the next time he comes to Mountain Brook.  I tried to get him to give me a DQ franchise when they took most of the work out of AC,  He just laughed.

If you figure out how much stock everybody had and you google and read the lawsuit over RL stock swaps,  It becomes very obvious that BR has the cash to do what he wants and virtually all of RL. 

There are a lot of non russell people around here who do things to make their land/ lot/home a nice place to live and they acquire the toys that make them happy.

BR is just doing the same thing on a bigger scale.  He doesn't need the money, can't spend all he has so why not buy all of the toys and amenities for he and his friends that he would like to.  

Woody is the guy that Wavely is barking about with the disappearing boat.

No idea of much of what you talk about in this post. Other than Mr. Morgan. I always liked Mr. Morgan. I don't think I loaned you a spanner? Maybe if I knew what a spanner was, it might jog my memory. And I don't know Warren or Woody, RC or Double Bridges. Ben will be fine, we agree on that. The people he has chosen to run his company the past 10 years will not be remembered fondly by his heirs, but likely for being the idiots that they are. They will do to Russell Lands what they did to Russell Corp (they already are). A pile of money can hide a lot of things. Stupidity and arrogance are not among them. Rob Peter, pay Paul. Daddy's gone to Key West, so its party time again.

Not a lawyer or an attorney and the advice is free so it is only worth what you pay for it but I would say you cannot depreciate something you don't own.
