After last season on the lake, I realized I was the only one incurring any expense amongst my friends going out with me.  This year I am seriously considering boating with guests that are willing to pay.  It is like renting my boat, except I will operate it (sorry, I don't trust others yet).  The guests will have complete say in where we go or any activity they want to participate in.  This will allow me to enjoy the lake and have others help with my expenses.  If anyone is interested, questions, ideas, or other, please let me know.

Do you have a Captains License? Do you need one? Better check if your liability insurance will cover passengers who pay for a ride. 

Do I Need A Captain’s License

Do I need one? A Captain’s license is only required if you are taking passengers for hire. Section 2101 of title 46, (21a) of the United States Code defines passenger for hire as follows:

“passenger for hire” means a passenger for whom consideration is contributed as a condition of carriage on the vessel, whether directly or indirectly flowing to the owner, charterer, operator, agent, or any other person having an interest in the vessel.

Section 2101 of title 46 (5a) defines “consideration” as an economic benefit, inducement, right, or profit including pecuniary (fancy attorney word for money) payment accruing to an individual, person, or entity, but not including a voluntary sharing of the actual expenses of the voyage, by monetary contribution or donation of fuel, food, beverage, or other supplies.” Additionally, employees or business clients that have not contributed for their carriage, and are carried for morale or entertainment purposes, are not considered as an exchange of consideration.

Bottom line: If you are a recreational boater, you are allowed to share expenses for a day on the water. Just don’t make payment mandatory if someone wants a boat ride.

My only question is in the Liability part...Also would you have to have a Captians License due to the fact that now you are "for Hire"?

I had considered the liability but honestly was completely unaware of needing a captain's license.   Thanks for the replies.

You are not renting your boat, just "sharing gas expenses".
I think you could avoid a lot of the legalities by doing that.

We don't share that problem with you, but did have a problem with the freeloaders, expecting food, beverage, lodging at our expense.  Made a rule, bring enough for yourself to share, help with the cooking/cleanup or don't bother to come back. Didn't take long to separate friends from freeloaders.  I suspect you will find similar results.

I've been trying (not very hard, but I do think about it) to think up an acceptable way for several neighbors to share ownership of a boat (I'm not interested in becoming a captain, or otherwise hiring myself out along with the boat.) I think of it every time I float around our little slough and see the hundreds of thousands of idle dollars tied up to various docks, bobbing gently up and down on their way to obsolescence. Surely there must be a reasonable way for a small number of nearby households to share those costs without annoying the hell out of each other and coming to enmity, blows or litigation.

Over 50 years at the Lake have taught me a few lessons, though. My Dad and uncle used to co-rent their old Lake place from Russell. They were the best of friends -- used to attend almost every Auburn football game together for decades. Got along great. But my Dad was punctilious about maintenance -- we never went home from the Lake without everyting being back in its place. My uncle's attitude was considerably more casual. He wasn't irresponsible, just not quite as tightly wrapped about things. Every ski rope that wasn't coiled and replaced just so, every life preserver left loose in the boat, used to drive my Dad crazy. It didn't come close to ruining their friendship. But it didn't help, either.

Just my .02 My neighbor and I shared a Seadoo. Worked pretty good for a while. But it never seemed to fail that when my daughter would fill it up with fuel and go ride, as soon as she got back to the pier for a break, his grand kids would show up and it was gone. And when it did come back, it was broke. Sharing was fine and financially beneficial for both of us. But when the extra people got involved, there was almost always an issue. On the other side of the issue, my other neighbor borrows my pontoon a couple of times a year to carry his little ones for a ride. He always helps me clean it up and he returns it with more fuel than it leaves with. But there is no financial involvement on his part. Other than the fact that the old boat is only worth the amount of fuel that's in it..

Forget the business aspect and just find a better class of friends, ones that don't mind helping out with fuel costs.  If they aren't willing then ride alone.  Who knows, you may run across a boat full of nice bumpers at the Rock.
