Subject:   Recent power line right of way trimming

I have been seeing a lot of  power line right of way trimming in the last 4 weeks.A little over 2 weeks ago the area in which we live had the right of way cutting. They did not come back and grub and collect the cuttings and left a big mess. On the main roads such as highway 63  where they are seen and probably inspected more they have cleaned the cuts. On the smaller roads in the developments and on more remote roads it's a different story. They have left huge piles of cut limbs and tree trunks on private property. I had assumed that a crew would come  after the trimmers and clean up but it has not happened. Now it is time to complain. I have seen both Davey Tree Service and Asplundh in the area but do not know which one cut in our area.

Have any of you experienced this ?

Yes. I have a ROW in the roadside part of my property and limbs were left everywhere.

We have a place in the Sandy Creek area and a couple of years ago these folks came through and did the same thing. My wife and I got madder than hell and got on the phone with Alabama Power and let them know about the mess these folks left after trimming. AP had some crews out there the next day to clean up the mess and we received a call to first apologize and second to make sure the mess was cleaned up. Get on the horn with AP and let them know how unhappy you are with the mess left behind. And if the trimming crew cut any of your shrubs, let AP know and they will give you a check to replace what was cut down.

Cut is bad but sometimes they spray and kill everything under the powerlines. My understanding was the ROW only gives them access to maintain their lines and you have to let there trucks come thru if needed.

I have been thinking on this for a few weeks now.   First the Alabama Power crews came through several weeks ago and did their usual butchering, er I mean cutting the APCO ROW.  But with the APCO contractors they clean as they go (more on that later).  The were about to "trim" one of my planted Saw Tooth Oaks when I stopped them.  They told me they had to trim everything within 15ft of the lines.  I demanded they measure cuz I was sure my tree was not within that range.  Informed them I would trim it when the need arises.  They very politely left.  They showed up the next day with a form I had to sign saying I refused them trimming.  Fine, I can live with that because all it means is that if that tree ever presents a problem they can bill me for damage to the pole and/or lines.  As I said, a true non-issue.

But in the last few weeks what has been working in the Madwind Rd. area is NOT APCO contractors, but county employees.  It appears that some local politician got a new toy, and now they have to justify the expenditure.  I saw it daily on my walks.  It is a brand new boom arm type thing with a rotating blade about 3 feet in diameter.  They cut EVERYTHING in sight.  They then would not come back for days or weeks to pick up limbs and send them through the grinder.  Even after they did that they left a horrible mess.

But all that pales in comparison to the flagrant disregard for property lines.  There are places where trees of over a foot in diameter were felled onto the private property and just left.  In one instance a section of private fence now has a moderate size tree laying on it.  It is freaking unbelievable.  I would bet that some of those 'trimmed' trees weren't even in the ROW, as they had to really reach out to get them.  They used to do this type clearing with a vertical 'bush hog' attachment on a tractor.  It is really astounding what can be done these days 'for the common good'.  I would estimate 99% of these recently cut trees were not even on the ROW, but that doesn't matter, they were having a blast playing with their new toy.

I have a place on Madwind where they felled 7 or 8 good sized trees onto my property. Does anyone know of a legal obligation for the county to get them cleaned up? I would be super duper pi$$ed, if I had a fence like my neighbor.

I am not a lawyer, but I say they have an ABSOLUTE obligation to clean up any mess left no private property.  It is disgraceful. That entire crew needs to be stopped.  As I stated, I am fairly certain that some of the downed trees were not even in the ROW.  And BTW, the county crews are about twice the size of the APCO  contractors that do the same job, only better.  As for the fence, I am still amazed at the amount of damage done to one fence, especially considering it belongs to a very wealthy lawyer.

I am only indirectly affected as they didn't come into my S/D, but you can rest assured, if they ever do with a mess like that I will be in the courthouse quick.  I can't believe somebody hasn't complained already.  There is substantial damage to one fence.  The wire is no longer taught for a long span and it still has trees laying on it that they cut over a month ago.
