Statewide Amendment 1: Called “The American and Alabama Laws for Alabama Courts Amendment,” Amendment 1 relates to the application of foreign law during the legal process involving an Alabama citizen. Foreign law refers to the laws of other countries or cultures. Currently, judges or other legal authorities discern whether foreign law is applied. Amendment 1 would create constitutional protection that foreign law is not applied if it violates the guaranteed rights of Alabama citizens.

Predictably, the Muslims from the Council on American-Islamic Relations (CAIR) were quick to post their outrage on Facebook, claiming that the amendment was racist.

Under Sharia Law, it is legal for husbands to stone their wives for adultery, and homosexuals can also be put to death for sodomy. Non-Muslims under Sharia Law are viewed as “infidels,” and any case brought before a court which recognizes Sharia Law would have to be viewed within the context of their religious beliefs. This means cases like the man in Oklahoma City who beheaded his co-worker would simply walk free because he would be protected by Sharia Law and therefore would not be subjected to the laws of this country.

Question:  Is Islam a race?

I don't think Islam or Muslim in a "race". But it does dictate a way of life.

Several years ago, I would have dismissed this Amendment as paranoia, but given the times we find ourselves in, it is probably a wise move.  Having said that, if Muslims take over the country and impose Shari'a Law, it won't be worth the paper it is written on.

Pennsylvania state judge Mark Martin relied on a Sharia law defense to dismiss an open-and-shut harassment case against a Muslim man who assaulted an atheist activist at a Halloween parade. [McCarthy, National Review Online, 24FEB12]

The subject amendment to the Alabama Constitution precludes introduction of any foreign, religious, and/or cultural law from being cited or used in any capacity in an Alabama courtroom. For example: Papal Bulls, UN proclamations, Mormon Law, Geneva Conventions, Boy Scout Laws, usw. One cannot cite a Georgia statute in an Alabama Courtroom. The citation must be framed in Alabama or Federal reference.

Shria Law does not trump First Amendment rights… no matter how offensive is the position of the victim.

Our Second amendment rights should go a long... long... way towards preventing any Muslim takeover of our country (provided the liberals don't discard it).

I'm sorry to say that I don't think that if Muslims take over the U.S. that there is going to be much regard for the Constitution - U.S. or AL.  They will come in like they have in other places and just start killing non-Muslims.

All the more reason to preserve the Second Amendment right to arm ourselves.

No disagreement there.
