WASHINGTON — House Republicans, overriding their top leaders, voted on Monday to significantly curtail the power of an independent ethics office set up in 2008 in the aftermath of corruption scandals that sent three members of Congress to jail.

The move to effectively kill the Office of Congressional Ethics was not made public until late Monday, when Representative Robert W. Goodlatte, Republican of Virginia and chairman of the House Judiciary Committee, announced that the House Republican Conference had approved the change. There was no advance notice or debate on the measure.

What Republicans actually did was address two lingering criticisms of the OCE, which was created by Pelosi’s Democrats after they took the House in 2006 (and before she undermined her own promises to “drain the swamp” by taking advantage of her position to buy Visa stock, while softening regulation on credit card companies).

The first criticism of the OCE is that it was too frequently confused with the House Ethics Committee, to which the OCE would refer complaints for further inquiry.

I looked back at the history of the OCE and found that in 2010, a Democrat and 19 other members of the Cong. Black Caucus tried to do the exact same thing as the Repubs tried to do 72 hours ago.  Their fear was that the OCE was the accuser, jury and judge for complaints that were to be sent on to the House Ethics Committee.  Doubt that the fair minded and impartial mainstream media will bring that to anyone's attention.  But I will.....

page 5 1-12  can not investigate in secret must tell someone they are being investigated.

page 5 21-25 rules only apply going forward, can not be used for past congressional misdeeds - they must be under current rules.

In a closed-door meeting on Monday night, Republicans moved to gut the already-limited power that OCE has to investigate members. Under a proposal from Rep. Bob Goodlatte (R. Va.),

the office would be renamed the Office of Congressional Complaint Review

and fall under direct oversight of the bipartisan House Ethics Committee.

The new office would have to halt any investigation if the bipartisan House Ethics Committee makes a written request to shut it down.

Anonymous tips to the office would no longer be accepted, and

any investigations that turn up potential criminal activity would be halted immediately and referred to the Ethics panel.

The committee has an equal number of members from each party, unlike the rest of the committees, which are constituted with the majority of members and the committee chair coming from the party that controls the House. This even split has limited its power by giving either political party an effective veto over the actions of the committee.
