Members of the Donald Trump transition team, possibly including Trump himself, were under U.S. government surveillance following November’s presidential election, House Intelligence Chairman Devin Nunes (R-Calif.) told reporters Wednesday.

Nunes said the surveillance appeared to be legal but that he was concerned because it was not related to the FBI’s investigation into Russia’s meddling in the election and was widely disseminated across the intelligence community.

“I have seen intelligence reports that clearly show that the president-elect and his team were, I guess, at least monitored,” Nunes told reporters. “It looks to me like it was all legally collected, but it was essentially a lot of information on the president-elect and his transition team and what they were doing.”

FBI and NSA have been very careful to say that Trump was not "targeted" for surveilance.  Trump Tower was not "targeted".  Obama didn't "order" surveilance, etc.  I think what we are going to find out is that whatever means they used to surveil the people targeted for investigation they captured conversations with President Trump.  We are going to find out that despite Trump's imprecise language he was essentially correct in his assertion.

"I recently confirmed that on numerous occasions, the intelligence community collected information on U.S. individuals involved in the Trump transition," Nunes told reporters.

"Details about U.S. persons involved in the incoming administration with little or no apparent foreign intelligence value were widely disseminated in intelligence community reports."

He said that the intelligence has nothing to do with Russia and that the collection occurred after the presidential election.

 

 

Still trying to see how it can be obtained legally. The politico story said it was a lot of information about what Trump and the transition team were doing.  Was someone reading daily appointment books to a foreign someone?  If not how can it be obtained legally without a search warrent unless it went through FISA and was scooped up due to talking to someone outside the US?

 

Since Comey could offer no evidence at the last hearing - I imagine the next hearing might be more interesting, but probably not.

This makes them relatively easy to overturn. Trump could issue directives to his appointees to weaken or abandon those restrictions. For example, he could make it easier for FBI agents to seize and stockpile the personal records of Americans and to obtain the phone records of journalists. He could also give federal criminal investigators even greater access to the troves of data collected, without warrants, by the NSA. But because many details of surveillance practices and restrictions are secret, we don’t know exactly what he could do.

If Trump were to remove restraints on investigators or authorize new surveillance programs, the public wouldn’t necessarily hear about it. Presidents can issue classified orders to change the rules for domestic spying, knowing that the other branches of government are unlikely to push back publicly even if the orders violate statutes. As the Supreme Court has repeatedly held, presidents have the final say over public disclosure of national security information. Opponents usually cannot criticize classified rules without illegally revealing them.

 

Most of it reads like the Obama playbook for his last months in office.

"And I'll tell you, NSA is being cooperative," Nunes continued, "but so far the FBI has not told us whether or not they’re going to respond to our March 15th letter, which is now a couple of weeks old.”

Nunes also reported that as of now, he "cannot rule out" President Obama ordering the surveillance. 

 

Comey is going to have some explaining to do at some point.  

 

And since the DNC / Bernie thing is just politics as usual and does not involve the Russians it is a nothing burger...

Updated 4:48 p.m.: Rep. Adam Schiff, the top Democrat on the House Intelligence Committee, blasted the panel’s Republican chairman in a statement over his claim that the Trump transition team was under surveillance. Schiff said the chairman, Rep. Devin Nunes, had not shared the information with him that led Nunes to make the claims — and said it was inappropriate for Nunes to brief the White House on them. “If accurate, this information should have been shared with members of the committee, but it has not been,” Schiff said. “The Chairman also shared this information with the White House before providing it to the committee, another profound irregularity, given that the matter is currently under investigation. I have expressed my grave concerns with the Chairman that a credible investigation cannot be conducted this way.” Schiff noted that claims made by Nunes do “not suggest — in any way — that the President was wiretapped by his predecessor." This story will be updated.
