Trump's defense is going to argue "free speech". 

In 1969, the Supreme Court held that inflammatory speech--and even speech advocating violence by members of the Ku Klux Klan--is protected under the First Amendment, unless the speech "is directed to inciting or producing imminent lawless action and is likely to incite or produce such action”.

This is the big question based on their premise of free speech.

I think it has less to do with the "fight" and more that he dares to question the election itself, much like demonrats did over the last 4 years and up until they flipped a few states there were claiming that there was election issues ( unless they won ) and for Hiden Xiden not to concede.

READ WHAT I POSTED.....All I wrote was that is the big question based on the preminse of free speech. Did his" free speech" incite the riot? His speech certainly encouraged some action. It was interpreted by his Republican supporters in the crowd to storm the Capitol and hang Mike Pence. What do you think would have happened if they had captured Pence? 

Why did he call Tuberville during the storming of the Capitol?

You keep saying something without providing the exact language he used that incited what happened at the Capitol.  This nonsense about people's defense of what they did because they "thought" that's what he meant is just that, nonsense.
