from what I hear, there were several people that were willing to stand up in court against Strats issues. 200+ people per night show their support for Chuck's. If my information is correct (not saying it is) the number of people supporting Strat's case is extremely miniscule. Remember. . .rights of the minority (being heard). . .rule of the majority.

I believe once the final tally came in, Gore received more popular votes nationwide than did Bush, however, he came up short in electoral college votes.

I thought that in the end, it was very close, but Bush took both. I dont know which of our memories is better though. Either way, my point was that the US is set up on a "right of the minority, rule by majority" system.

Doc is right, Gore won the popular vote, but lost the electorial college. The ironic thing is that when it was set up by the framers, they did it due to lag time in comunication. Now it works by not allowing the large metropolitan centers rule election day.

And actually, you have it wrong about rights of the minority but majority rules. Majority rules also means 'mob rule'. If majority ruled we might still have slavery, women would not be allowed to vote, etc. etc. What the framers created was a 'representative republic'. The folks we send to Washington are supposed to listen to all constituents, and then vote their conscious, based on what is their opinion of the best for the folks back home. Of course that was when we actually had 'citizen legislators' that voted on what was best for the 'folks back home', and not what was best for themselves or campaign contributors.

The rights of the minority can NEVER be greater than the rights of the majority. EQUAL rights for all. And I know the arguments that blacks and women were excluded at the time. The key there is 'at that time'. when the time was right, it was the very same constitution and process they used to gain the 'equal' status. So the system works!!

That is the ONLY reason I oppose gay marriage. They have the same right ot marry as I do, that is to say 'equal'. What they seek is elevated status, a special right. I also know that if it is passed, then I have the right to marry a man, but trust me I want. Unless he is filthy rich, half dead, impotent, and able to sign a pre-nup and will that leaves it all to me.... lol. ( A little humor there ) Once you open that door for one, it is wide open for all. The slippery slope theory. But it is the SAME argument that is used to defeat such things as euphanasia (SP?).

Still think majority should rule?

You think you know what you're talking about. I know everyone that contributed money for the court case. Full timers, weekenders, and people that just wanted to contribute.

Some that contributed will not tell you to your face and I will not reveal their identities because I gave my word at the beginning. And I am good for my word.

A neighborhood is a neighborhood......not a home for a honkytonk. Just because you want something.....doesn't mean you'll always get it......especially at someone else's expense.

You guys talk tolerance.....but you have no clue as to the meaning of the word.

... they went to government indoctranation centers for 12 years. Now me, I went to a wonderful public school back in the old days. Had to walk 12 miles, uphill both ways, with no shoes, toting 40 pounds of books, barefoot in the snow, after doing all the chores round the farm.

Gotcha. I thought you were making reference to the Florida vote which affected the electorial college. Even though it is coming up again and again by the Democrats this week, there were no less than 12 "recounts" conducted under the watchful eyes of the media (e.g. New York Times, CNN, NBC, etc.) and other very partisan groups, every single "recount" is on record (if you dig far enough) showing that Bush won the state.

And since a lawsuit was filed. The whole deal now revolves around a legal mix of homeowner's property rights, a business's expectation to make a profit, civil rights, obscure noise and nuisance laws and hundreds of other twists and turns a lawyer and judge make add to the case.

The majority normally only rules when voting, but even that has limitations. Often in courts, extra steps are taken not to step on anyone's rights which often means the minority position wins.

As a fact, Gore won the popular vote, but luckily we had the electoral college. Since they still don't have voting machines that work in Florida, it might happen again this year, too.

Lake noise or not, I wish I was on LM instead of hearing trucks rumble on Interstate 65 and sirens day and night.

One thing that hacked off lots of folks in TN was Gore leasing part of the family farm to a Swedish strip mining company. It polluted well water for miles around. He made money from it, so it was OK.
He also had a house that was unlivable where a family had to move out since he wouldn't fix it. Of course, the Republicans helped move the young family out.
All this from a guy who tells us to stop driving cars and how endangered the environment is.
Geeeesh.....
No wonder he lost TN. We know him well.

yes, but laws are either made by elected officials or voted into existence by a majority vote. These laws are also enforced by judges that were either elected or appointed by an elected official. Therefore, in a round about way, majority rules. The judge, after hearing both sides of the arguement and applying applicable laws, has made a decision. I, along with the majority of people affected by this case, continue to enjoy karaoke at Chucks. The system worked.

I think the worst things the judges do aside from impropertly interpreting the constitution and inventing laws is relying so heavily on precedent. They are not judges anymore ...just parrots for whatever chain of judicial decisions made before them. That's why these whack-o's go out to the northern Califirnia district to try these so called precedent setting cases.

But back to the Chucks thing - I have no personal knowledge of the problem but sooner or later as the area develops there will be zoning and use regulations. Then there will be no way you materially change a property use like that and get away with it - no matter how much some may like or enjoy it. As more people are packed in tighter and tighter I think that is a good thing.

Not me. I was refering to judges in general, especially federal judges. I wasn't even thinking of the Chucks case. I think what that judge did was simply apply a compremise. Fair enough. Local Judges, IMHO, do not have the power to create the havoc from the bench that federal judges can. More specifically, appeals judges.

RR has a very valid point about precedent and the 9th Curcuit ( AKA circus) court of Appeals in CA. And recently we had a U.S. Supreme court decision that actually quoted a foreign court decision. Very dangerous stuff there. I wish I could remember case and court, but I have CRS. It should be easy enough to Google though.

Anyway, we are in the same hymnal, just different pages.

The system works for those with money.

The person with the most expensive lawyer always wins. Just look at O.J. Simpson. It's got nothing to do with right or wrong....it has to do with how deep your pocket are and sometimes who you know.

The result of the court case at Chuck's is now being taken advantage of by circumventing the ruling and having bands on Fridays instead of Karaoke....which was stopped on Fridays.

I don't call that a working judicial system. I call it a farce. : D

Enjoy it for now......it's not over.......we're still working on it. : D

I remember in some of your other posts you made the comment that you like music, but that karaoke wasnt music. It's a bunch of wailing rednecks, right? Now they have bands on those nights. You like music dont you? Not liking music seems unhealthy. Are these bands not music? Could you not sit out on the peir, drink a cold one, and enjoy the music?

As far as zoning. Wouldnt a newly drawn up zoning law take into account businesses that are already established? I have never heard of operations having to close down because of a new zone. Virtually every shoreline of the lake will one day have a house on it. That doesnt mean that marina's are going to have to close their doors to accomodate residential zones. Clauses will just have to be written in to allow for pre-zoning establishments. Chucks is already licensed to do every different kind of business that they do. Zoning will not take that away.

The difference is......the marina is making it mandatory.....in other words....we have no choice whether we want loud music or not.

We're working on noise ordinances and zoning now. We'll see how it comes out.

Eventually.....this area will be part of Dadeville and a noise ordinance will apply anyway. We're working with Law Enforcement and other municipalities and people in office getting this show on the road.

Everything is being documented so that it is in black and white and status check performed periodically. : D

It will come to pass....maybe not as fast as we would like......but it will happen. : D

Gives us something to look forward to......our quality of life back!! : D

Chuck's was never liscensed to do karoke......it has been a marina since the 1960's........pizza just since the middle 1990's......and simply started karaoke on it's own without anyone's permission since 2000.

It's not the marina we have a problem with......it's been here and has bothered no one. It's the mandatory karaoke and loud music since 2000 that is the only problem. There is a difference there Sigmapi.

I have stated this from the beginning. We're not asking to shut down the marina......just the loud music and karaoke from April - October....8:00 - 11:00pm every Friday and Saturday....holidays.....special days and events....every year.

Our neighborhood has been hijacked and taken advantage of now for over 4 years......and we're not stopping until we get results. Count on that for sure.
