Kudo's to the Gov and the Alabama legislature for stepping up to the plate and passing eminent domain legislation that should protect us all. From what I've read, the only area of concern is a "blighted property" loophole that, with enough calls to your local reps, has a chance to be closed. Now, it's Georgia's turn........

Sorry but Ga. will doubtfully follow in 'Bama's footsteps. Ga. has ugly dreams of being the financial capital of the country with little Atlantas popping up everywhere. The last thing the "powers that be" care about in this state is our rights. It's all about money and funding. Personal property rights mean nothing to our leaders. Tax revenue fills coffers. Too bad the state isn't located on a fault line. Then there might be hope.

Judge Andrew Napaliano, often seen on FOX news, wrote an excellent book on this subject. The "blighted area" rule came in the 1930's in NYC. Public Use became Public Good. Later, in the 1950's NYC condemded six acres on the water that was 3% blighted.

A group of men had gotten together to put up a redevelopement plan when all agreed on the buildings, profit share, etc. However, one man let his 3% of the land area's buildings get run down as they were to be torn down anyway. NYC jumped in and condemded the six acres on the water for a Harbor Control Authority. This is somewhat of a Public Use. However, The Public part was less than 0.05% of the total square footage. The rest was rented out for world trade.

July 1, 2005 two men were evicted from their land in CA (so what? Who cares about CA) Their crime? The land was too good for them. .The city had plans for years to put up a big developement that would raise the tax base, increase jobs and net property taxes. So, one man who emmigrated here after WWII and put up a money making and well mantained tire and battery store in 1949 was thrown out of his business. The minute the Supreme court order came in, this City Hall voted to re-convene at night to start the condemnation proceedings.

We are blessed that The Great State of Alabama acted so quickly.
