Some of the people who oppose the big boat ban have been telling us, that the problem is not the big boats. although the big, the fast and the big and fast each like the pwc creates its own set of problems, the condo's are what really will create problems beyond what any of us can imagine.

Did you know that for all practical purposes you can only have one dock on you lake front property, yet if you put a condo on that property, apc no longer regulates what you can have. it is then up to the ACE. And they are currently letting developers put hundreds of docks on shorelines just like your's.

Either some existing organization of lake lovers, or a new one needs to take up the cause. Lake Martin if it is to retain any of its pleasantness must have new restrictions on what can and cannot be constructed on its shore lines.

Did you know that many lakes in other states have restrictions that houses cannot be built within hundreds of yards of the shore line nor can any trees or growth be removed in that buffer zone.

It is time that such restrictions be placed on our lake. This plus stoping the condo's is necessary to preserve the lake.

If by "ACE", you mean the Army Corps of Engineers, they are not the most critical agency for Lake Martin approvals. For commercial docks, seawalls, and shorline issues, the use permits must go through several agencies (Health Dept, ADEM, Historical Commission, ACE, Conservation Dept, etc) before being submitted to Alabama Power and, if all those approve, APC, and all neighboring property owners have been notified, then it goes to the Federal Energy Regulatory Commission in Washington for their approval. The process takes a while, but it makes certain that all commercial facilities are well done and constructed properly.

The last time we went through that, it took the better part of a year to get our permit.

I agree that uncontrolled growth is going to be the major problem. Not only do you have the growth, but Tallapoosa County didn't even have a building permit requirement at the time I built. Now they have a permit, but no real inspection of building projects, structure, electrical, foundation, nothing. Zoning does not exist. I guess the county politicians love the condos because it's new tax money for them, with no effort or expenditure.

Lord help us of us who are homeowners on the lake if that is the case. Although the Alabama Legislature passed it's eminent domain legislation last year, the '"devil is in the details". Its' broadly defined "blighted" definition of property creates a large loophole that I believe was discussed in this legislative session, but no action taken. Someone correct me if I'm wrong.

It would also be valuable if we could, as a forum, list all new condo developments and their locations that we are aware of. Public awareness always gets politicians attention.

I'm not about to step into the middle of one of these arguments. But at Sunset Point in Stillwaters it has taken almost 2 years to get the neccessary permits to put the floating docks in. They are still not in but should be this month, so APCO isn't just letting them throw up docks.

APCO does have strict rules on anything built below the 490' line, but they make their own rules ( with FERC oversight), My point is the county really has no restrictions or oversight on what is built, how densely built, or how well built. The covenants for any Russell Lands development are very strict, but they are not county rules or regulations. It's time for the county to step up and grow with the lake--earn your new tax revenue.
