In the Sep 2006 issue of Lake Magazine Walter Ramey of Alabama Power said that anyone who wanted to build a dock must own at least 100 ft of linear shoreline. “The main reason is to prevent clutter”. It does not look very good docks bunched close together. It also can be unsafe. When I read this I agreed with what he said. Then today I rode over by Stillwaters and saw the new condos going up. There are docks/boat slips every 10 feet or so on the existing condos. I’m wondering if the new condos will have docks as well. Every 10 feet or so seems cluttered and unsafe to me.

Hi fulltimer, I would agree with you. I assume by your handle your are local, and the phone call to APCO would be local. Give them a call and find out for us. In fact, they may have a 1-800 number??? I will have to read the article. I just recieved my copy last night and left it home. I am 1/2 way to the Lake and will grab anotherf copy when I get down. Please post what you find out.

Condos get by it by calling their docks, marinas; therefore, they come under the commercial restrictions.

You left out the disclaimer from the article...

The 100 feet rule is the standard, but it is not necessarily set in stone. "If they're close to that, we will work with them," Ramey said.

I thought the same thing as you!

Welcome to the world of developement..... Remember the "big boat ban"... I am afraid there are more deals/developement coming down the pipeline by the dozens. I think all this is going to make for a very, very crowded lake martin.

I don't know what the plan is for the condos on the 'Pointe', however, the condos going up by the chapel are as follows (or so we have heard). There are plans for 140 condos there, but there won't be a boat slip for every condo. Also the boat slips will not be assigned, so it will be a free-for-all to park your boat. It's my understanding that the developer had to get a marina license to have the large number of slips. Since it is already getting crowded in this slough, it should be interesting to see what happens if they put slips all the way around the boardwalk they have built.

On another note, we have been very curious for a long time as to how they got permission to built the condos on the Pointe so close to the water. I thought there had to be a 30' easement. Does anyone know how they got around that?

The 30 ft. easement only applies to land that was owned by Alabama Power. Developers (Russell Lands) can set restrictions in the covenants when selling land. A title search may be needed to determine if your land has any restrictions.

Every time I pass by one of the public boat ramps on the weekend and see all the boats that have been hauled to the lake from all over I think

There are also new rules for commercial property, including marinas. You can only have 1,000 square feet of dock (including the space where the boat is parked) per 100' for shoreline in the project. That means that a condo or marina development can only have about 3 each 10 x 20 ft docks for each 100 ft of shoreline. There are also property line setbacks and maximum length from the shoreline restrictions.

Treating things as a commercial development only works if you have plenty of shoreline.

I've been wondering about these "rules" too. There are plenty of houses on the lake with less than 100' that have docks. Not just older areas, newer developments like Marin Cottages, The Preserve at Stoney Ridge, The Village, have docks on 40 to 80 ft lots. It looks more like the rules only apply to large lot owners. If you subdivide it, you still seem to get one dock per lot.

Thank goodness they restrict; maybe that'll discourage potential buyers and these half-a$$ projects will go bankrupt.
