Someone recently decided to remove the buoys from Chimney Rock. My personal cost in this matter is around the sum of $300 for cleats, stainless steel cable, concrete, and foam. Other boaters also have spent money, time, and effort installing their own buoys. Whether or not this person is aware of boating laws, when a buoy is installed by a private party, the buoy becomes public property. No matter what this person’s feelings are in this matter towards the individuals who conjugate at Chimney Rock, this person destructed public property. Any information concerning this matter is greatly appreciated. P.N.

This also happened last year, same time frame. These items are not cheap, and this is a felloneous act.

It will not keep people from the area, as most of us know how to use an anchor...

may remove those buoys if they were not approved before they were installed. I know you can't put any other kind of buoy in the water without their approval.

Rumor has it, that the marine police were fine with the placement of the bouys. I know some upset individuals have contacted them about the removal, and it seems that the marine police agree that who ever cut the bouys have interfered with the recreational use law and that what they did was plain theft and if found will be prosecuted.

just out of curiosity, you heard a 'rumor' that the Marine Police okayed the anchor buoys--does that mean that they gave formal approval or just turned their head? Got no dog in your hunt, just wanted to know because I may want to put a buoy out elsewhere. The Marine Police has responded to this forum in the past--any comments?

The Marine Police would rather see people using well built, and anchored buoys at The Rock which will not break away, than for alternative methods which could be a Safety concern.

And regardless of who or why they were taken it was still illegal (Unless there was a legitimate reason by the Marine Police themselves). The poeple who put the buoys in had clearly marked their names on them. The Marine Police have been questioned, and they did not know who removed them.

Whether or not there was an offical request, I am not sure. Maybe an official request is in order, and the buoys thaqt go out can be identified as public use, do not remove etc.

What I meant by marine police okaying them is that they had no problems with the bouys and consider them public use. Just like the rest of the lake is... public use. The problem is that you have people who think they own the water because their house backs up to it... but in fact it is there for everyone to use. If someone spends their hard earned money and their time to go and place a bouy out there, what sense does it make to cut the line? What good would be accomplished by it? People are still going to tie up regardless. If someone don't like the fact that everyone ties up then there is plenty of other parts on the lake that they can go and avoid that area.

I had talked with the water patrol early last season. He informed me that the buoys that were placed at the Rock were fine. He had a problem with mine and with a few adjustments resolved. It is perfectly legal to have a buoy there as long as the position does not interfer with traffic or main waterway. The owner of the buoy is responsible for any damage done by the buoy through contact of another boat. However, once placed there the buoy becomes public property. I never asked anyone to untie from mine. I actully ended up meeting some nice people over the Summer that were tied to it.
I questioned a water patrol about the buoys yesterday. The water patrol had nothing to do with the removal of the buoys.

I'm sorry for your loss, but I do think you meant people who "congregate" at Chimney Rock." It's wonderful to try to imagine rafts of boats at Chimney Rock conjugating. Certainly, they don't conjugate on the forum, or spell, or even coax their subjects and verbs into agreeing. Maybe we should all congregate at Chimney Rock (Acapulco Rock for the purists) and have a spelling bee.

Someone cut the Ski Course buoys in Sandy Creek last year--they'd been there for years--don't know why people do stuff sometimes.

If the Marine Police is OK with it, maybe they could give an official approval and put an official buoy or buoys there. That's about the only place on the lake where people like to raft up so they should justify it for safety reasons. Too deep to anchor in main channel and you're out of the way between the islands--so a buoy makes sense. APCo owns Acapulco Island and Russell owns Chimney Rock Island--have you checked with them to see if they may have removed the buoys?

I did not check with either of the two. If R.L. did take up the buoys they are in violation of the law. Even if they do own the property A.P.C. would have control of anything from the right of way forth. I will ask at the next A.P.C. meeting. I will put out another one in the next couple of weeks. I can promise this, without an under water cutting torch, the next will be there for years to come.
