Several of you have given good suggestions about how to make sure Sandy Creek and Lake Martin residents are assured that immediate action is being taken by the City of Dadeville to improve their sewage treatment plant facilities to prevent further illegal discharges of raw sewage into streams leading to Lake Martin.

First, would everyone that reads this forum and has property on Sandy Creek please post below just to let us know who is involved.

Second, if you have property on Sandy and will help or have ideas to share, please post.

Let's get this info first, then we'll include everyone who cares.

I am on the other end of the lake but count me in for support! This is a great thing you are doing and is truly a bigger problem than water levels, big boats or developers who "rape" the land. Clean water has to be issue number one. I think we can all unite around this critical issue!

Do we have a lawyer on the forum who would "pro bono" file a class action. Perhaps a lake owner...there has got to be hundreds of them....

As I have stated, we live off Cricket Road and will be glad to do whatever we can to help. However at this time, help might be limited due to a serious illness in my immediate famly which will require a few months to complete and I don't get very far from home the majority of the time.
I do have a suggestion. We really need to have a water test in several areas of Sandy Creek as opposed to several in other parts of the lake to compare pollution levels. These test results should help to verify the problem, therefore justifying further action. I truly hope everyone realizes just how much this problem will eventually affect all of Lake Martin and the help of all is needed.

I took a ride up in to Sandy Creek the other day and was surprised at what I saw. I was in the area where Sandy makes a sharp turn to the NNE. On my map, it is in the area of the GPS reading 85 degree's 49' 10". The water was just boiling. I am no expert on what could be causing this, but, something was definitely fermenting down there. This was late afternoon and the water was calm. It may be a good place for the TV crews to get some live action shots.

I am not in the Sandy Creek area, but what happens on one part of the lake does affect us all. I agree that the water should be tested by an independent source. If you guys start a fund to help off set some of those costs, let me know and I will chip in. Good luck and keep us updated on the forum.

Here is a bit of information on the Dadeville situation that might be of interest to you and other Forum readers.

In response to an earlier post about getting an attorney to pursue a suit, our legal counsel advises that once the State Attorney General files suit, another suit filed for violations of the Clean Water Act is basically precluded because the burden of proof is so high. You must convince a court that the State is not "diligently prosecuting" the case. That's what preempted a possible Lake Watch suit.

Of course, a suit for damage to property can be filed...but again, the burden of proof.....

Be assured that Lake Watch is directly involved in making certain Dadeville does what must be done. Among other things, we have a monitoring program in the Sandy Creek area and will add a bacteria protocol this summer to see what the treatment plant discharge is doing to the lake in that area. I will post results periodically if anyone is interested.

However, our bacteria protocol is limited to a simple test for e-coli and is not lab quality. If we begin getting spikes in our testing, we usually call in the health department.

Readers should know that Lake Watch recently wrote to the Alabama Department of Environmental Management requesting they conduct a public hearing before any action is taken to renew the Dadeville plant's permit (it expires 30 June 2007). We've asked that the hearing be either in Dadeville High School or Central Alabama Community College in Alex City. The purpose is to allow citizens an opportunity to ask exactly what ADEM plans to get the treatment plant into compliance.

For those that are truly concerned about the lake, I would encourage them to get involved. Do not expect your state, county and city governments to do the right thing. Only when we speak up will serious issues be addressed.

Thanks for your response and for the responses of all. We all appreciate the work of Lake Watch and your volunteers that keep an eye on our lake, and we know that the sewage situation in Dadeville may have never come to our attention without your efforts--the City of Dadeville certainly didn't volunteer any information for 5 years, we feel that more publicity about the condition of the sewage treatment plant and the lack of action by the city will hasten action to correct the problem.

Personally, I don't feel more legal action against the city will be beneficial. For some reason I've never felt that suing a public entity accomplished anything (The City politicians would use your tax dollars to defend themselves against your lawsuit with you spending your money to sue--something is wrong with that picture).

I do feel that the members of this forum represent an important group, Lake Martin stakeholders. If we can gain the interest of Montgomery and Birmingham media outlets (TV and Newspapers), can present a true picture of the pollution situation, the history--why a 5 year delay, and when the problem will be corrected. My hope is to augment the work that Lake Watch has done, and of course Lake Watch will be the environmental voice of Lake Martin. Hopefully, forum members can help gain us contacts in the media to help get out the word that the Lake needs help.

The best results I have ever seen when dealing with politicians is putting them under the heat of public scrutiny. Lawsuits get political action in 2-3 years; TV cameras get action today.
