The shame of it is the jerk probably beat a BUI charge by running, but I sure hope they throw the book at him. Does anyone know if he was an out-of-towner or a local regular lake user? For the sake of the victoms, I hope he had insurance.

what amazes me is he was very concerned about his 20k motor allegidly. But, shouldnt he have been more concerned about the people he injured or at least the 80+k boat he hit?

His "self esteem" could be too high. The rules just don't apply to some people you know.

To be fair we don't know all the facts yet. It will be interesting to see what unravels and to hear his side of the story. If I were betting on it though I would bet on your conclusion.

Me and some friends were discussing this same issue yesterday. Not sure which is going to be worse though, leaving the scene of an accident with injuries or the BUI.

This one will be interesting to see play out.

Leaving the scene of an accident with injuries is a felony, whereas the BUI is a mere misdemeanor. He certainly made the wrong choice.

Alabama Law:

Assuming the law applies to boating:

Every person convicted of violating Sections 32-10-1 through 32-10-5 or any of the provisions thereof, when such violation involved only damage to property, shall be punished the same as prescribed by law for a Class A misdemeanor; provided, however, that every person convicted of violating such sections, or any provisions thereof, when such violation involved death or personal injury, shall be punished the same as prescribed by law for a Class C felony.

Most of us posters were not at the scene. The driver made a very bad decision to leave the scene. I could imagine however whether BUI or not that the driver may also have suffered some sort of head injury (temporary?) or shock which may have led to the poor judgement.

Not defending anyone, just stating a possibility for the "other side".

I would like to find out what happened, to hear cause of accident, and to hear final outcome. (Orage colored Fountain, lighting, position of parked boat etc..)

whether he came forward on his own immediately after he got his boat to safety. If the law had to track him down with leads furnished by witnesses then he should rot in jail. Hopefully, we'll find out the truth. Only Ted Kennedy can get away with leaving injured or dead at an accident scene.

I agree, he (or she) will pay for their poor judgement. I am sure the punishment will fit the crime. The obvious guess is that the person ran to avoid BUI. However, since this is the obvious guess I was just adding that there may have been other reasons for the person to leave the scene.

I hope that the person did come forward and will cover any financial burden caused by the damages, (to include any pain and suffering).

This should be a not to everyone who boats at night- don't make the fireworks show your only night trip of the year. Stay familiar with the water and do not stop in in mid channel (not that tis person did, just that stopping in mid channel at night would not be a wise thing to do)... Also, a hand held spot-light does wonders at getting peoples attention...

Good points PP, people should learn to boat at night, so they know what to expect on the fourth, but it is also wise to slow it down at night. I have noticed from sitting on the dock that boats are b@lls to the wall out on the lake at night. There is no reason for that. Take it slow, watch for hazards and other boats, look up at the beautiful stars that seem to glow brighter on lake martin then any other place, and thank the good Lord that we have such a wonderul lake to enjoy.

that the victom was "stopped in mid-channel" and "parked". Seems that you know more about the accident than I've been able to find out. Did the felon turn himself in or was he hunted down? BTW, he did become a felon the moment he left injured people in the water. I do not like boating at night with or w/o radar, there are just too many fools out there. I agree with ALSCN's comment below.

hey guys,
I personally know and respect the victims in this ordeal and you can be assured that they are very lake savy and have been on this lake for 40 years. There were not anchored, moored and or even idling in the main channel. They were just easily navigating their way home after the fireworks show.

The thing is Shoe that these people were more than likely doing everything they could to create a safe environment but the boat that hit them obviously wasn't. I think what PP was saying was we all don't know the facts and that there are certain things that can be done to try to avoid such an accident, and for all to take that part into account and try to do their best while on the lake.

I never claimed they were just sitting there. Just stating that would not be a very wise thing to do. I honestly have no first-hand information about this accident, and have made no judgement as to what caused the accident. Obviously one boat hit another one. The boat that was the apparent cause of the wreck left the scene. Those are the only facts that I have been presented with.

I am sure that the marine police will document the findings and we will be presented with those findings.

I agree that leaving the scene of an injury accident is a hanous act and I am sure the person will pay their due. BUT, since I wasn't there I was just stating that there may be another reason for the poor judgement. One would immediately assume that the preson was BUI, and there is a high probability that they were (statistically speaking). But it isn't up to me to presume that.

I hope everyone is OK, and I hope others learn from this mis-fortune.

Maybe a positive has come from the low water. Some people are being more cautious...

BUT, it was interresting to me that during the daylight hours people were driving almost directly over the caution buoys in Kowaliga Bay, and at night they were avoiding it like the plague.

July 4 is the one night of the year when more people are on the lake that shouldn't be than any other time of the year, and no one was killed.

for even the most experienced folks at night. There are simply places on the lake that you don't realize are low until you're almost on top of it. No markings for many low places.
