First I have to tell you that I respect your right, and those of your fellow plaintiffs, to challenge the Big Boat law before a judge. This is a great country.

I spoke with the good doctor (you know who I mean) yesterday afternoon. He said that things didn't go well for your group during yesterday's hearing in Montgomery. He said that your Jasper boat dealer did very poorly under cross.

Having noticed your post that suggested that the big boat and fast boat crowd was inflluential and having heard a different side to the story I wondered if you and he attended the same hearing. What's your take on the situation?

Thanks for respecting my right as a citizen. Also, I don't share the same opinion as some others. (Thats what makes us individuals) I am sure you will respect my right to keep my opinion to myself. The "influential" post was made because we all enjoy the lake, and we should not be divided in groups. Contrary to what some may believe, we are much stronger as a group. Regaurdless of the outcome of the boat ban, I will continue to contribute to this forum, and the lake as I have always tried to do. There has never been any attemp to mask my opinion or position here. Nor will they be in the future.

I feel ya. Would you mind sharing what the current ruling on big fast boats is? I am unsure. I saw some very large crafts in the water at the South end this past weekend. Just curious.

More than likely they were "grandfathered" in. Just because there is a ban does not mean they will disappear. The boat ban came with a grandfather clause which also include all the big ones you see under the protective white wrappers at the marinas which have yet to be purchased.

On the contrary, his answers were technically correct to the questions that were being asked. Those questions were misleading and technically incorrect to the facts of hydrodynamics. It is up to the judge to understand who the experts are, and who are not...

This is all a matter of public record...

I am the Jasper boat dealer that supposedly did "very poorly" under cross. Hey guys,I'm just a boat dealer,I am not an attorney or a professional expert witness. This is only the second time in my 40 years as a dealer to be on the witness stand and I have to tell you I was out of my element. If I screwed up I appoligize to my fellow plaintiffs,but the defendant's lawyer did blindside me on a few issues. No problem,that's his job, and he was good at it. When the judge chastised him for badgering the witness,I tried to stay calm. When he got into go-cart tracks,and deer hunting with automatic weapons, and so othe weird stuff,the judge stopped him. I had no idea where he was going,I don't race go-carts and I don't hunt,so maybe my answers were a little off.I tried to tell the absolute truth in every answer but a lot of it was like the old lawyer story "Answer yes or no,do you still beat up your wife?" If the Professor was a good witness for their side,no problem,he seemed like a nice guy,but by his own admission he has made a lot of money in the past giving expert testimony,so he knew how to be a professional witness while I did not . Again,I am just a boat dealer who knows boats,I do not know courtroom procedure very well. But as Pier Pressure just said,it is now up to the judge. I am sure that if your testimony was as forthright and eloquent as your post the judge will recognize this and weigh testimony accordingly.

Unfortunately with the deep pockets and strong ties of your opponents the 'fix may be in'. I wish you, and co-plaintiffs the best of luck. Hopefully, no appeal will be necassary, but if it is I think your chances are better the further away from Montgomery that you get.

Mr. Nelems. With all due respect, you were respected more by the court than you realize. I spent many hours on the phone during the evening with folks that count. You did a great job. Nothing was said that has not been said 100 times over the last 18 months. Everyone else... The forum here is not a good place to discuss this lawsuit! The particular comment about the boat dealer didn't come from the person that I attributed it to and "did poorly" may not have been the actual words that were stated. I apologize to Mr. Nelems and to the forum members for my choice of shorthand.

Pier Pressure is apparently correct. Mr. Nelems was said to have answered the questions directed to him by his attorney.

I regret bringing this matter to the forum. An e-mail message to CAT BOAT would have been a much wiser choice.

Thanks for the comment,no apology necessary. Even tho I live on a different lake ,I am just as passionate about the quality of life on Smith Lake as all of ya'll are about Lake Martin. We actually are all in this together. We sometimes may have a different slant on an issue or two ,but overall I think we all share a common goal of enjoying our lakes without causing problems for others. Peace,Robert

That was no hearing (as you stated), it was OUR trial. Hundreds of hours were spent by many citizens to fight for what that particular group stood for. Right or wrong, (as opinions go) makes no difference! The next time you don't like a law past in legislation, you go and grab the "bull by the horns" and challenge "The State of Alabama". Get ready, you'll learn more than you care too about legislation/politics, influence and a whole lot more. You'll have to raise money to support your efforts as well. (Unless you have bottomless pockets like APCO). It was called grass roots from the beginning, and its grass roots now. I respect your appology Carnac, but it aint been fun. Stated "opinions" I have heard enough of. In my opinion, I heard nothing that I have not heard in the past year and half or so. That is my opinion only! I guess we will all know soon enough.

and admit to you that I truly hope that all of the go fast and big boat crowd who were operating their boats on Lake Martin before the bill became a law do get grandfathered. It simply wouldn't be fair to ban you and them from using any of the three lakes that the law covers.

Having admitted that I have to also say that if the law is upheld no more of those boats should be allowed to operate on those three lakes. Twenty-some years ago I boated regularly on Lanier and it was already overcrowded by those types of boats. Guess what, it's gotten almost infinitely worse. We've absolutely got to keep this lake from suffering the same fate as Lanier.

As Robert Nelems has indicated we all have most things and concerns in common where it comes to preserving the quality of life on our lakes.

I think one of the major problems is for those who do not keep their boats on the Lake but launch and use the Lake on a frequent basis.

Yes, I was wondering about that, too. In my area we have tons of folks who do not live on the lake but come here to party. What are the pros and cons of charging folks to use the lake? Don't want to start trouble. I just wonder if people should have to contribute more for what they are using (and for the lake problems they are contributing to). I'm going to Lanier this weekend to see for myself. I have heard so much about how awful it is. The Atlantians are moving down here. That is clear from the number of new neighbors I have from Atlanta.

With time the lake will be overpopulated, regardless of the types of boats you ban. If they wanted to limit the number of big boats they could have just stopped allowing more wetslips that accomodate them. That wouldn't have been difficult and it wouldn't have caused this mess. Now you will simply see an overcrowding of trailered boats and you will still wonder why it is so rough in the big water.... With the condos going up and further development, it will happen.
