Interesting article in B'ham news today about APCO suing the sod farmer over "their" water. Perhaps it's semantics but in this article APCO is calling Lay Lake a reservoir being used to store water and generate electricity.

Seems they flip/flop on this as before they said Lay was a run of the river, not a reservoir needed to generate electricity therefor stayed higher than Logan Martin which is a reservoir.

Hmmm.

Just like any politician APCO releases statements that support whatever they are trying to accomplish.

I bet if you look deeper into this you will find that APCO and this man have a history of some sort of disagreements. Probably something about wanting his land and him refusing to give in.

If anyone knows anything else about this, please keep us updated. I am curious about the history and exactly what you could bring out about APCO in the courtroom.

I'm not trying to turn anyone into a "jailhouse lawyer" by posting this url below, but sometimes when i have questions about legal matters such as the sod farms use of water and "riparian rights"..... heck I never heard of those rights before so I looked it up. Sometimes the code of Al. is difficult to read for some of us. If you follow this link there is a search bar that you can type your inquiry into, I entered "riparian rights" read through the code.
As ignorance of the law is no valid defense, this can be a good resource for questions about the law, or you may be like me, it may raise many more. Sometimes its like reading gobeldy gook...........(is that spelled right) anyway, with the lake levels being so controversial and the upcoming meeting this thurs,I may be sifting through the codes again.

Someone posted a link to the corp of engineers once i would like to have that url again, and thats next on my list to search for this morning
