The post regarding the so called "hit and run" on our lake. Just so everyone knows. All charges were dropped. It never was a hit and run. The story in the paper last summer was an abomination of justice and printed so far out of context that it led all to believe the the parties were guilty. Charges were filed but latter all were dropped but one which didnt have anything to do with the accident. The parties went to trial and the judge dismissed the remaining charge against all three parties. Hope that clears up some of the rumors regarding this.

I spoke with the people who were hit the next morning at the Marina where the boat had been towed. The guy who hit them didn' stick around and help. Not sure what you want to call that?

I spoke to the one that 'hit them'. He tells a totally differnt story. There are two side to EVERY story and the absolute truth always falls somewhere in the middle.

I thought that a couple of them had plead guilty to misdemeanors, although I was shocked that some of the charges were actually classified as such.

We could debate this for days, and in the end neither of us would be swayed I'm sure. The fact is that everyone's version of the truth is swayed by their perception, and perception is reallity. Problem is our perceptions are also clouded by our prejudices and bias, and we all have them. Anyone that claims not to is not being honest with themselves, much less anyone else.

facts are facts too. Sometimes the facts speak for themselves. There are plenty of people who can give just facts without interjecting opinion when it comes to recounting an accident or other such event.

Eyewitness testimony has been shown time and time again to be among the LEAST reliable, yet it is still given the greatest credence in most cases. Almost all of the recent rash of folks being released from prison after new forensic (mostly DNA) evidence has shown them to be innocent were originally convicted mostly on 'eyewitness testimony'. Sometimes that of the victim themselves.

Charges were dropped because length of time it was taking the judge and attorneys to bring the case to court. Also it was clear they were only going to charge them with misdemeanors. The older couple that was hit in the accident were recently contacted by the judicial system of tallapoosa county( nine months after the accident) about the case and getting it started, they decided to drop the charges due to cost of prosecuting what the court had deterined to be a misdemeanor. they were just happy to be alive and have insurance cover expense of everything lost. Yes i know there are two sides to every story and i do not claim to know who was wrong or who was right. It is not my nature to judge people. I just hope those involved and everyone else has learned to be extremely courtesy and vigilant when on the lake at night.

that there are three sides to every story.........your side .........my side .........and then just the facts (truth) which may fall in the middle giving some credence to each sides version.
