Big company using their muscle to stop individuals from expressing their views on a blog board which I thought was a 1st amedment right. People should always be truthful, but politicians lie, distort the truth, etc all the time about each other, I wonder how they see this as different. I am sure those that posted something they were sharing what they feel was their understanding of the truth. Not sure how that can be liable. Very sensitive. I wonder if one of these posts struck a chord somehow.

Looks to me like those folks are giving the collective finger to RL; a much deserved finger at that, if that letter is real

Bruce, have you ever gotten a letter from the RL attorneys? I've read things on this site that were much worse that those posts.

No, I haven't received a letter. That post was made on this forum back in July and I removed it as soon as I checked out a few things. That kind of allegation has no place on a bread and butter site such as this. If the poster felt his/her allegations could be proven, were in the public interest or had evidence to contribute, it should be brought to the attention of proper authorities first, not on a public forum. The proper authority in this case would likely be the Alabama State Fire Marshal or the Elmore County District Attorney. The part of the post that implicates a crime is groundless criticism that RL has a right to retaliate against.

In my case, the poster did not have a name or telephone number on file in my database, nor did they come forward to me with information of how to further substantiate allegations that a crime had been committed... That would make it the least bit newsworthy. So how could I possibly take it seriously?

Then, I discussed the post with a friend of mine who is a District Court Judge. That particular post could be considered slander per se...Categories are as follows:

(i) Accusing someone of a crime
(ii) Alleging that someone has a foul or loathsome disease
(iii) Adversely reflecting on a person’s fitness to conduct her business or trade
(iv) Imputing serious sexual misconduct (especially the chastity of a woman)

Regardless, that kind of content is best for sites like SLM. Notice the difference between their site and mine is you can pick up a phone and call me from a published number, but they don't want you to know who is behind that site... I can't blame them considering the content and what I believe their agenda to be. As the saying goes, “To each his own”.

I'm in the advertising business and work to help businesses prosper. That's my job! I don't want my lake sites to be known as the epitome of controversy for causes which are not my own. I don’t really appreciate people using my assets (forum or otherwise) to further their agenda at my expense or at the expense of the people I’m working to help.

I look at it this way… If I had let the post remain, then I would have been looked upon as I was in agreement with it. Not my intent… I would probably have a similar letter now... Either way, I lose being criticized by someone.

I’ve said enough and will comment no further on this topic. Have a good evening folks.

"It violates the First Amendment!!" and "freedom of speech" are thrown around a lot by people who don't understand either one. According to many definitions, we couldn't possible have slander or libel laws because of the First Amendment.

That being said, I have read the thread on the other site, and what I see is a lot of opinion and eyewitness accounts. There might be a lot being said that some people don't want said, but in the end, the truth is a defense. I can't offer any proof, but BASED ON MY EXPERIENCES and IN MY OPINION, I can believe every word of what they are saying over there. In fact, I would be surprised if they aren't just scratching the surface.

Well then you better go back to law school. Although I did not know you could get a law degree from the community college in Alex City.

Now if you really were a judge, then you would be able to site some of the specific cases you tried in your court.

I'll bet you can't even name one!!! Go ahead, name one.

never said I was a judge. Just tried cases in front of judges with 1st A isssues. You cannot get away with statements such as "In my opinion I saw x suck a donky dong"
Unless it happens to be the truth that x sucked a donky dong.

If you think I am wrong prove it by going into a federal court and saying to the judge
"In my opinion I say you sucking a donkey dong last night" and see what happens.

I have a hundred dollar bill that says you will be found in contempt and the 1stA won't save you.

Come on Water Watcher - I'm sure many of us excelled in law school, passed the bar on the 1st try, stood before numerous judges and juries and still have differing opinions on 1st amendment rights and elements of defamation. Lighten up.
