How long do you have to live in the state before you can pay instate tuition? We have had property and have paid taxes for 4 years but won't live on the lake until my son graduates in another year .

I would strongly suggest you contact the University your child would be attending as I would bet such is diff from institution to institution.

To give you an example of friend of mines nephew began college at a major university in AL and did not live in state and neither did parents. But then a year later they in theory would qualify as both lived in state and both paid AL income taxes, etc.

Now for the SURPRISE, per this university what ever your standing is with regards to tuition status is day one is what it will remain for the remainder of your education. So they now live in state and still have to pay out of state tuition.

For Auburn, you need to be a resident of Alabama for a minimum of one year. If your child went to high school in another state, they will ask for one full year of Alabama state income tax returns, an Alabama drivers license, and proof of residence including property information and utility bills......if you have only been paying property tax, it will not be enough to satisfy the requirements. I believe other state schools require similar information, but I only have direct experience with Auburn.

Also, many schools (like Auburn) used to let the student establish residency, not necessarily the parents. I think that changed several years ago.

That is exactly right ... the key is they want a state tax return. I got in state for my son when he went to Auburn but only in years 2-4. I had owned my home well before that but they said I needed to claim residency. So I changed my "official" address to the lake address and stated filing a state income tax return .... but because I had no income earned in the state of Alabama it was a zero return ... but that worked just fine as long as I filed it each year. My federal return showed the Alabama address as well.
