my dog was just attacked in HER yard by 3 yellow labs (maybe golden retrievers) with collars on! one of the collars was orange. i screamed and shot at them with a BB gun. i live down Old Susanna Rd. next time i will shoot to kill.
(maggie is on the front of the LM dogs page in the photo gallery..she's old..had i not seen it happening they would have killed her!)
I PROMISE I WON'T LET THIS HAPPEN AGAIN!

I can understand your outrage, but it seems unusual to me that labs would be attacking your dog. It's usually not in their nature to attack. They can be rowdy though, and they may have been trying to rouse your dog into play.
I don't condone shooting dogs except as a last resort. I understand that you thought you had to do something. But, I would hope that you could catch one of the dogs that has a collar on and find out who the owner is. Call them and tell them that you don't appreciate them letting their dog run free or coming into your yard.
Shooting to kill seems a bit extreme. Would a better solution be to just bring your dog in until the meandering dogs leave?

Although I am a dog lover, I think you should treat them as you do people - if they are a threat to kill your dog - shoot them. Be humane, and shoot only if you have a good shot - no wounding. You should not be forced to change your habits or your dog's simply because someone does not respect your rights or property.

I had the same issue with a neighbor, I found the info listed below from Ala law, then he and I had a very cordial, blunt discussion regarding his dogs attacking me and my dogs on my property. According to Alabama law, dogs get "one free bite". Second one is on the owner and will be extraordinarily costly to the owner if the dog bites me twice. Neighbor disposed of the dog that bit me and he keeps all his other dogs off my property. They do, however roam free elsewhere in the neighborhood. Biggest problem with free ranging domestic animals is that there is no county-wide dog catcher in Tallapoosa county, and the county is too financially strapped to initiate and/or enforce dog rules.
§ 3-1-5. Permitting dogs to run at large; applicability of provisions of section in counties and certain cities or towns.
(a) Every person owning or having in charge any dog or dogs shall at all times confine such dog or dogs to the limits of his own premises or the premises on which such dog or dogs is or are regularly kept. Nothing in this section shall prevent the owner of any dog or dogs or other person or persons having such dog or dogs in his or their charge from allowing such dog or dogs to accompany such owner or other person or persons elsewhere than on the premises on which such dog or dogs is or are regularly kept. Any person violating this section shall be guilty of a misdemeanor and shall be fined not less than $2.00 nor more than $50.00.
(b) This section shall not apply to the running at large of any dog or dogs within the corporate limits of any city or town in this state that requires a license tag to be kept on dogs nor shall this section apply in any county in this state until the same has been adopted by the county commission of such county.

§ 3-1-6. Liability of owner, etc., for injuries to livestock, etc., caused by dog while off premises of owner, etc.
If any dog, not being at the time on the premises of the owner or person having charge thereof, shall kill or injure any livestock, the owner or person having such dog in charge shall be liable for damages sustained by the killing or maiming of any livestock and for the full costs of the action.

It's not the dogs fault. It is the fault of a careless owner.
I still think that the best approach is to contact the owner and let them know that their dogs are a problem.
Shooting still seems like a last resort to me for dogs that are obviously someone's pet.

I was down on Old Susannah about a week ago, and I saw two ladies walking and there were three yellow labs walking with them. It looked like they had a place down near the boat ramp, or perhaps further down Old Susannah. One lady was tall and blonde and appeared to be in her 40's or early 50's. The other lady was older.

well, i am much calmer now! there is no way i could kill a pet. that being said i have no problem shooting them with a BB gun. unfortunately, i am not a good shot. a little sting would have done any one of those dogs some good. (if my dog were in your yard and you didn't want her there i wouldn't be upset if you gave her a sting to make sure she never came back.) when dogs run in a pack like that they can be aggressive..i don't care what the breed. my dog is an outside dog...even if she wasn't i wouldn't put her up while someone else's brats ran free thru my yard. as far as playing...she was crying in pain while they were jumping her and came away bleeding...doesn't sound like fun to me!
i guess if one of those dogs gets close enough to me i will get the phone # and collect the vet bill from them!

The dogs hang out 3850 Old sussanna Rd. They are always there when I deliver. They are not the owners but they can tell you who is.

You are entitled to use deadly force to defend your dogs, so do it.

Alabama is a one bite rule state. It will be important to speak to your county attorney and find out how they interpret the law. The one bite rule means that the dog owner gets one pass of letting their dog bite you. If you warn them and it attacks again, then they can be held responsible. We learned this after a dog attacked my child when he was walking home from school. I asked them nicely to please contain the dog before something happened because he was getting old and aggressive. They did nothing. I warned them that I would call the animal control if they did not contain it to their property. They refused and went out and added a pit bull puppy to tag along with the older aggressive dog. I called the animal control. They would not pick it up because it had a rabies tag and didn't not care that it was loose even though we have a leash law in our county. It is up to how the county interprets the law. I then contacted the home owners Insurance company and advised them of the problem. The dog now has a nice fenced in yard to stay and play in. I went forward with this because my child was able to defend himself but the dog lives in front of a daily bus stop for elementary school children and are mostly K-3 age. The dog was a full size 80# plus dog.
