What is interesting is that the government is now trying to argue that the penalty is in fact a tax despite all the loud protestations that it was not a new tax. Methinks Mr. Obama outsmarted himself and is now in a tenuous political situation.

What I like about this particular ruling is that it also ruled on the lack of severability so the entire law is thrown out. Dems would be wise to rail against the courts and let the ruling stand rather than fight it.......don't think that will happen. Would love nothing more than to be debating Obamacare leading up to 2012.
