In the majority of states, you cannot sue your health insurance provider in civil court to hold it responsible for treatment decisions. You can only sue in these 17 states: Arizona, California, Georgia, Illinois, Maine, Minnesota, Missouri, New Hampshire, New Jersey, North Carolina, Oklahoma, Oregon, South Dakota, Tennessee, Texas, Washington and West Virginia. So at least in 17 states you can in fact sue your carrier for their coverage decisions. And guess what, my carrier is based in Georgia so we can sue them if we want. Funny how your source didn't tell the whole story....why is that?

If you have any type of problem with your health insurance company or their practices, you can take your complaint to an external review board in most states. The only states without an external grieving practice are Idaho, Mississippi, Nebraska, North Dakota, South Dakota and Wyoming. So in all but five states in the country you in fact have the ability to use some form dispute process (either litigation or appeal to a board) that is separate and distinct from the carrier itself. So if this is important to you then move! In addition, you always have the option to change carriers if you are unhappy. We do this every year with our program when we take it to the markets to test our premium, coverages and level of service.

Now lets compare that to a federal government board that would be making these decisions. Who are you going to go to then GF?!?!? You can't move to another state to get this right if you want it. Heck, you can't even sue the federal government without their permission. And if you think they are going to grant that right to you when Grandma dies because she had to wait 6 months for an MRI that would have discovered that aneurism I have some ocean front property in Arizona that you will just love. I mean, for crying out loud give this some real critical thought....
